Yeah it makes sense. He/She starts drinking as soon as they can legally which now means they start when they walk in the door. Now if they could drink in their car legally it's only common sense to assume they'd start as soon as they left the store with their beer in hand which means in the car.

My argument stands. Passing additional laws in an effort to prevent the breaking of existing laws does nothing but punish innocent people, and create more crimes.

All in all, the OP is stupid for drinking with an open container because its easy to get caught. However, Without a doubt, one beer ain't gonna make him higher than a .02% AFTER it hits him, anyone can drive with a .02(even under 21), AND that beer will take 15-20 minutes to hit his system anyway!

Seriously, a sh!tload of laws make no sense. I know 14yr olds that are more mature that 22 yr olds. So then why is much "responsibility" given to us at the age of 18? Some people are ready to drive when they're 14. Some aren't ready to drive until they're 25.

Drinking. 21 years of age...why? Seems arbitrary to me. I've been drinking since I was 8...only "socially" though...I have no interest in getting drunk.

Anyhow this is just the point. Our system is composed of knee-jerk reactions & over-simplifications. The government doesn't have the time or luxury to treat every case individually. As it is, there's already too much BS nitpicking in the legal system.

And how would you prove that intent to break and enter ? I can follow whoever I wish as long as they stay on public roads, unless they have a restraining order, of course I can't legally follow them onto private land. The local sheriff is a great guy, I'm nothing but appriciative of his work, but they also appriciate the concerned citizens that help them out

It's something that can't be explained...has nothing to do with how good the chicken or beer is. It's much of the same feeling you get at a Cub's game while eating a real hot dog and drinking Old Style....you just have to do it to get it. ;)

Ok, here's a new situation for you.

Suppose they find no open container. Either the driver ditched it, what you thought was beer really wasn't, or the cops just couldn't see it(they can't search your car just because some asshole called and claimed to see a beer).

Suppose its a real d!ckhole cop who takes him into the station. Lets say he's had .5-1 beers. His BAC registers at .01. He drives home completely unpunished, as he wasn't driving drunk, you're an asshole who just wasted alot of his and the cops time.
