If your check writing spree is reported to the State, and their attorneys decide that you wrote or cashed those checks with fraudulent intent, they could bring charges. The collection agency doesn't do that, they simply want you to pay what you owe.

They are suing you in civil court, not criminal court.

Basically, as long as you pay some amount reqularly, there isn't all that much they can do. Tell them you will give them $40 every couple weeks(and try not to bounce those cheques :p).

Also, you do not want your wages garnished. Not only will that taint the hell out of your credit report, you'll never get a decent job again, either. They look for that in background checks (and most applications ask you about it).

Seriously. Call up the collectors and give them the rundown of your financial situation. Explain to them that you want to do whatever you are financially capable of to clear this up.

I think you'd be getting more sympathy here had you not "eluded" them in the first place.

Maybe if you hadn't tried to elude them for a month and you had just owned up to your "mistake" and paid the money you owed they wouldn't be taking you to court. They are probaby going to try to charge you with some kind of fraud.

How about downscaling the wants of your family and just pay for your needs? If you're working 80+ hour weeks and still have trouble paying your bills - you're living out of your means, and foolish.

Seriously though, how are there not bench warrants out on you for each of those checks.

the wife/kid excuse can garner you only so much sympathy. If my son was starving I wouldn't do something that could potentially land me in jail. If I'm in jail then guess what, my son suffers.

So by your logic if my son is starving I can rob a bank and use that as a defense.

well, you are screwed then. If i read correctly then it was more than one check, one mistake. it was a series of checks all lower than $150 each, totallig over $1,800. not a mistake really, huh?

Well, I successfully eluded them for about a month now and they finally caught up to me. I made a mistake earlier this year with some checks, and now the collection agency wants to take me to court for the amount of 1833 and a 35 dollar filing fee. The thing is, all of these checks never exceed 150 dollars,and are a group of smaller amount checks.

I could be wrong, but I read that to mean that he wrong numerous checks, all under $150. each to the tune of over $1,800.

1. Call the collection agency (duh)
2. If you're working 80hr weeks and still living paycheck to paycheck, you need to look hard at what you're spending your money on and make some serious changes.
3. Idiot for avoiding them.

So, I assume this is small claims court? Doesn't sound like they are pursuing any criminal charges they just want their money. You don't necessarily need a lawyer for that. Just show up and plead your case...assuming you have one. Have they been threatening toward you? If so, you could use that in your defense (you'll need proof of course). Maybe the judge would consider that when deciding how much you have to pay.

If you don't show up they side with the collection agency for the entire amount and your wages will be garnished. If you show up with a weak or no defense they will side with the collection agency but you might be able to get them to agree to drop the late fees etc...not sure on that though.
