So I got a letter from my landlord....

Although our house might be dirtier than average at a given time, we do clean periodically, vaccuum about once a month, etc. Our kitchen is usually clean too. However, we all had exams up until the 21st, leaving us no time to clean the mess we accumalated during that time.

that is not an excuse to leave your house so dirty and messy that your landlord had to leave a note with you and won't be renewing your lease because its so bad ...


just becausee you had finals doesn't mean you should let your house get into such a horrible condition that it causes the landlord to put you in this situation. i have been to college and finished a couple years ago, its just not an excuse.

i mean you had a bag of throw up ... that is just filthy. you had clothes (whether dirty or clean) all over the house in hallways. you all marked up the walls of his newly painted house, you broke furniture.

i dunno man, from what i've heard, i don't feel sorry for you at all. your living conditions just seem kind of disgusting if you ask me.

More clarification:
The only furniture that was broken is stuff on the patio, which is going to the garbage anyways. There was no other furniture included in the house, other then a couch which is in perfect condition.

THe bag of throw up: This is a bag which someone through up in the night before we left the house (we don't know who did it, but we had some people over that night). We left early in the morning and din't even know about it (we didn't know anyone thourugh up, and we didn't smell anything either). When we got back, however, we smelt it, and promptly got rid of it.

There are NO marks on the walls, except a few random scuff marks. THere is a hole in the wall that was caused moving a chair into one of the bedrooms. We will patch that up b4 we leave.


Actually, fixing a problem like a hole in the wall without notifying your management company or landlord may not be a good idea......

Also, I am pretty sure that if you have a patio, your lease states that trash is not to be left on there.

i never once had a bag of throw-up sitting in my living space, i never once broke furniture in my living space, i never once had dirty clothes (or any clothes for that matter) scattered on floors other than in my own bedroom.

and on top of that, i never had any dirty crap all over the place for more than 2 days if even that much. leaving rotting food and trash around for weeks (as it sounds in the letter received in the OP) is nothing that I did nor saw anyone do in college w/the exception of a few people. its just disgusting.

Ok I have to admit I didn't read the letter.

I thought it was the usual clothes on the bed, beer bottles type of thing.

It really does not matter that the bag of puke was from the night before! what matters is there was a bag of puke in the first place.

I guess we've established the landlord can choose not to renew your lease. Is that the problem? Or is it no big deal that you have to move?

THis was a one time situation that happened in our house where (i believe) someone puked in a garbage bag without us knowing, and tied it up. The smell was not evident when we left the house to go home for christmas break. WE DIDN"T KNOW SOMEONE PUKED. We found out a coupla weeks later when we got back from christmas break, and the smell had spread. We promptly cleaned it up.

Do you think the land lord cared that you couldn't clean it up because you weren't home during the break? All he saw/smell was that bag of puke on the floor for weeks
 
Basically, the landlord has every right to refuse the leasing of your residence for the next school year. I would put down some money that it stipulates in the lease about cleanliness and the landlord having the right to evict or refuse leasing. The landlord is evicting you for basically being a slob. You're making excuses for the things you admit were there, such as that bag of vomit. While I'm on the topic of that vomit bag, let me say that you're excuse of "we didn't see it" isn't good enough. If you cleaned regularly (once a week or every 2 weeks) you would have seen that bag, disposed of it, and that would have been the end of the story.

Some points to take a look at:

-About that broken furniture: Why didn't you just throw it away right after it got broken?

-Your landlord states that they spent $20,000 on renovations last year. I hate to break it to you buddy, but you and your room mates putting scuff marks and holes in the wall would piss just about any landlord off. If I dropped $2K on renovations and some people are scuffing up the walls and putting holes in them, I would be pissed off as well.

-You asked why he came back a week later in the OP. I'll tell you why he checked back in. He has every right to enter your residence, as long as he gives you proper notice, which it sounds like he has. He's checking back to check up on the condition of the mess to see if you cleaned it up or not.

-Why are you leaving leftover food around? Get off your ass, walk two feet to the trash can and throw your stuff away.

-You say you guys walk on the carpet with your socks. I bet that not every single person who visited your house took off their shoes before walking in, did they? Also, the dirt wouldn't be a problem if you vacuumed regularly, more than once a month.

-The landlord is right, he is NOT your personal cleaning service. This isn't your parents' house, and mommy will not come and clean up after you. Take some responsibility and clean on a regular basis. Every other weekend, vaccum, clean the bathroom and other locations such as the kitchen and take out the garbage. I garuntee that doing a decent cleaning job will ont take you more than an hour and a half, tops.

Don't make excuses for you being a slob. Bottom line: Yes, the landlord can kick you out or refuse to renew your lease.







 
we cleaned up any food that would rot. Garbage bags full of food and such were left at the curb. THere were two other bags that had "non-perishable" stuff in them that we left indoors (one of these bags had the puke in them).

And, what do you think we are, idiots? Hole in the wall "that was caused by moving a chair into one of the bedrooms"??! Did you leave out some details like "the chair got accidentally moved into the bedroom during a wrestling match"?

I've helped several people move. I've moved several times myself. I have seen scratches put on walls, generally from BIG items. Never have I seen a hole in the wall caused by moving stuff, and NEVER have I seen someone so incompetent that they were even capable of putting a hole in a wall with "a chair."

The way he described it is paradise compared to the house I lived in in college. That thing was partied into the ground.
 
all the people saying you need to live in a clean environment are idiots. How is it hurting ANYTHING by having your laundry on the floor in the living room. If I want to stack some broken furniture in the middle of my living room that is MY right to do so.

Having the landlord give a timeline to when you should do dishes by is insane. However, once you start attracting bugs than I would say the landlord is in full right to step in. Having puke laying around is pretty unsanitary and nasty but again if its not doing any harm to the building and isn't attracting bugs I don't see how the landlord could ever evict someone over this.

Every house I went to including mine during college was a disaster with beer cans, clothes, general stuff laying around everywhere.

Choosing to not rent to you next year is their right but they sure as hell can't evict you over this and carpet falls into wear and tear which is what your security deposit is for. Unless they specifically say you can't wear shoes in your lease than they can goto hell.

h is not evicting you... he is refusing to renew your lease. there is a difference.

it is his property and he can do what he likes with it... within the confines of the law in your state. Since he is not throwing you out... but waiting for your lease to expire and not renewing... he is within his legal rights to do this.

As far as your personal cleaning habits... i will not adress that. That is between what you think is ok to live with and what the landlord thinks is acceptable in his property. He wins, i guess.

"In fact, over the Christmas holidays, there was a massive amount of garbage all over the kitchen and living room." - ahhhh, you said "2 bags"... this must mean there was one bag in the kitchen and one bag in the living room.

"Remember that any damages caused by the tenant will be charged back to the Tenant or his Guarantor." I guess this means that mommy, who must have been picking up after you for the past 18 years, is going to have to pick up the tab for you after the security deposit fails to cover the damages.

The landlord was mistaken on several accounts. the guaranteurs are not going have to pay anything, because the house will be cleaned by the time we leave. I'm not debating that it's messy. I just wanted feedback on whether the house had to be spotless all the time, or just clean when we leave.
