Summary. Man starts argument with woman for parking in a handicap spot without a permit. Husband of woman comes out and sees argument and pushes man to the ground but then steps back. Man on ground pulls out a gun and shoots the husband in the chest. He dies.

It has been ruled he can not be charged under Florida's current stand your ground laws.
 
Wait a minute, if the Husband only pushes the man to the ground, then steps back and doesn't continue attacking him, then I see no reason for the man to pull out gun and shoot.

I agree the bar is way too low. Literally all you need to do to legally kill someone is start an argument and have them respond physically in the most minimal of ways according to this decision.

He didn’t hit him. He didn’t continue attacking him. He wasn’t standing over top of him.

The standard is way too low.

Well, I'm sure what he did to the shooter would qualify as assault in some way. Something to kill someone over? Fuck no. Shooter needs to see some jail time for that shit
 
I think we can all agree on one thing here...designated handicap spots are to blame for this senseless tragedy. If stupid liberals had never championed for Americans with Disabilities, one husband might still be alive today. Designated handicapped spots are responsible for more incidents of road rage than their proponents would ever care to admit. I think it's about time we got rid of them. Luckily, a law-abiding citizen had a gun to defend himself, otherwise the bodycount could've been higher.
 
If the guy shoved to the ground hit his head on the pavement, that could be a life threatening injury. The guy doing the shoving unnecessarily escalated the situation.

Too many guns. Assume everyone is armed.
 
Thing is, arguing with someone over why they're parking in a handicap spot with no sticker isn't illegal or violent. Walking up to someone and striking them hard enough to remove them from their feet is both. That dad could have simply walked up to the guy and said "deal with me, we forgot the ticket, are you a cop?" or whatever, but instead choose to play a stupid game in a state that awards stupid prizes. The other guy was calm and not being violent, no one was in danger.

It's horrible that he went down in front of his kid. I expect the guy will walk, even though I don't believe use of a gun was warranted here. The victim clearly showed compliance and backed off before the shot was fired.

As I see the video, the assailant continues to move forward towards the shooter UNTIL the gun is drawn and brandished.

Given the law.... would brandishing be more illegal than killing the guy and claiming "stand your ground"?
I'm actually thinking it'd be worse, legally, to not shoot. Which is morally abhorrent.

He could have had an M2817A3476XR leg gun mount that he was prepping to use or this young buck could have stomped on the victim.

I was thinking the same thing. If he had drawn and NOT fired, he may have been in more trouble.

I actually have a Florida firearms/self defense law book written by a second ammendment rights lawyer on my bookshelf, I should take a look.

I don't know about Florida's laws, but I thought that once the attacker backs off and flees you are supposed to let him flee.

That is what we all would have preferred. Where the man on the ground would diffuse the situation, not escalate it by killing the guy. Morally there should be a crime for that given the context of the video.

AFAIK here in IL, if someone enters your place, you just can't shoot him. That person has to be an actual threat or give you good reason to believe that he is.
