They had a zero percent chance of achieving what you are saying. That’s totally changing the scenario of what happened into a grand conspiracy that would likely involve many other crimes.
Also the potential six years in jail is being left out.

In many states if you fail to commit murder it is the punishment as doing the act….

That shoudn't absolve them in any way or lessen the punishment. They are still liable/responsible/culpable for the (shitty) attempt.

Correct and I believe a $10k fine plus up to six years imprisonment is appropriate.
