Hey MOMO,
I also have Associates National Bank and they sent a letter asking if I still wanted to dispute the charges yesterday. So I just refaxed the info to somelady named tanya, if she won't help with the dispute, I'll get in touch with your contact person, gevonia browns. btw, do you have any suggestions to make my case stronger? I disputed the service agreement and they asked if i contacted the merchant, I tried to call them but did not get in touch and i didn't send email, so i have no record...hopefully they will look at your case and mine and say it's ok for the recredit. Thanks for the info momo.

I'm with USAA Credit Card Services... and they've been great! Anybody with a family connection to the Armed Services ought to see about getting one of their cards... All of their services seem to be VERY customer-oriented.

I'm with USAA too. When I called them they said that the dispute period is only 30 days. Have you had any success in disputing the charge with them? If so, what did you do? By the way my card with them is a Visa.

I disputed on the fact that i never received my Cpu. I told them the whole story and how they failed to contact me. I also pointed out that i've tried many times to return the cpu-less computer{I had no intentions on returning it,It just made my case stronger}, but they dont respond to any phone calls and emails.

My story seemed to be enough for them. :)

hope you have the same luck :)

Yep, mine's a VISA too. I had NO problems with my dispute, though I had also called in within if not 30 days certainly the first month and a half or so and had them put a note on my account that I was dubious as to whether I'd ever get the services for which I was charged that $371. When they went bankrupt, I simply sent a letter certified mail to USAA requesting a credit dispute because shopps was not going to be able to provide the services for which I paid (1-year shopping membership) due to bankruptcy, enclosed a copy of the SEC filing linked above with relevant sections highlighted, and USAA credited my account.

Good luck! I'm pretty certain you'll be able to get a credit. If it's helpful to you, the name of the rep who handled my dispute is Vera Lopez.

Truth be told....the people who got their full systems AND never intended on using/renewing their membership (about 99.9992%) are taking advantage of shopss.coN's circumstances and immorally requesting their membership fee and even worse(in 99.99991% of the cases) their shipping charges be fully refunded.

Those of us who never even received a complete machine on the other hand, have never had any "consideration" for the contract to be valid.

Let your conscience be your guide. GOF FOR IT!!! LOL

Hey LevcoS, which SEC filing would be the most useful for my dispute, the quarterly or Annual report? Also, do you remember which sections you highlighted. And I just want to make sure that you didn't mention the CPU'less computer. Sorry about all the questions, but I just want to make sure I get this right the first time. Thanks.

Give me $371 and I will write you the same contract as shopss.com gives me. Best of all, I also write everything in contract as shopss.com has done such as
1) give u a PIII computer as shopss.com's one if my financial condition allows
2) give u promise that I might ship u a computer and I really have no idea when I will do it because I might not have $ to order it
3) give u a computer without a CPU if you request but I do not guarantee I can ship it if I run out of my inventory or if I have it at the first place
4) even if I ship it I might not ship everything because shortage of components whether it's due to market condition or my financial condition

I just want you to make sure you sign and agree on 3 conditions
1) You will let your conscience guide you to support a broke person like me
2) You will not dispute my charge
3) You will not seek any mental aid from any competent professionals in medical field such as psychiatrist and the likes to support u in agreeing with the contract

The reason I throw #3 in because I am afraid for your freedom being that could be threaten because they might force you to stay in a mental hospital for a very extended time.

If you agree then I will send you the contract, the paypal account so you can send your money in. Deal?

I sent in the annual report. I don't remember exactly what I highlighted... basically, I read the thing and highlighted every place it said "We're broke!", "We're going put of buisiness!", or "We can't fill orders!"

About the time shopss stopped answering their phones, Nicky (marketing?) told me they had upwards of 800 CPUs still outstanding. I haven't any idea how many people waiting for CPUs requested shipment of incomplete systems, but you've got to figure MAYBE half, if that high. Wholesale total on the parts in the incomplete systems at that time was somewhere around... I'm estimating $310 more or less at a quick guesstimate, so figure they get no "profit" on 400 of 800 after shipping... so 400 x $371 = $148,400. Wholesale of the 500s and 550Es they shipped out while they were still shipping CPUs was around $300 so total cost to them on each complete machine they shipped was probably in the neighborhood of $600 for a total loss on every complete machine shipped of $229, give or take shipping costs. Figure at least a thousand complete systems shipped, since they IIRC were estimating doing at least 2000 of these systems and as mentined a moment ago 800 of them were never finished, and they're taking a loss of over $80,000 even before you start figuring how much loss they're taking as people get charges overturned.

The point of which being: Yes, they took a lot of us to the cleaners, but they sure as hell didn't get rich doing it... they took themselves to the cleaners too- as evidenced by their annual report!

Sorry for being a bit off topic. I've finally gotten around to getting a processor for my CPU-less shopss computer. I picked up PIII 667 (for the AOpen mobo). Am having trouble getting it going and am a relative neophyte in this biz. If you wouldn't mind handing out a few tips, please drop me an e-mail (so as not to clutter up the board).

In case anyone even reads this thread, I have to ask:
Did any of you disputers charge the Shopss fee to an
American Express? I disputed my charge and they finally
got back to me with a credit of $50. I talked to a
customer service guy, and he said he'd re-submit the
dispute, but I should probably send in more info. I'm
curious as to whether anyone else got a full refund and
how many hoops you had to jump through.

I filed my dispute a several weeks ago. They lost my fax or did not want to sift through all 30 some odd pages. I re-sent it via snail mail. Today I got a letter from the claims office. They provisionaly credited my account but want me to send back the CPU less computer. Then send them a copy of the signed return reciept. I was claiming for $299 since that is the cost of the gold service and they are provisionaly crediting me $371. I stated in my claim that I was contending the lack of the gold service. I really don't want to send back the box after all the hell Shopss has put me through, besides I cant talk to anyone at shopss on the phone and get an RMA nor can I get into their web site. I don't feel I should have to send the box back since it was supposed to be free.

Opinions/Ideas ?

Ponch, write them back and fax/mail it to them (use faxforfree if you do not have a fax machine) and politely explain that you did not buy a computer, you purchased a prepaid membership to a web portal that was to provide a myriad of services and it is GONE and that there are no goods associated with the charge to return. You can quote the portion of the contract that says the computer is free and yours to keep in the event of a breach if you want, but I might try just ignoring the computer for one round of correspondance.

What is the bank on the CC ?
