PASADENA, Calif. - A shopping cart that had been hoisted atop a supermarket flagpole by pranksters fell on a store employee and broke her neck.

The cart fell Saturday as the woman untied the rope to raise the flag, as she did every day when she went to work, police Lt. Lisa Perrine said Tuesday.

Shantie Marjal, 62, was hospitalized in serious condition. Police said she had a broken neck and suffered serious head injuries but was not paralyzed.

I've raised hundreds of flags over my lifetime. Who doesn't look up a flagpole before raising a flag?

That really sucks for her though

i disagree, their motive albeit stupid, wasn't to injure someone, they were just trying to be pranksters. it was a freak accident, and they need to be punished, but don't through in juvenile care just because it was a prank gone bad.

Prank or not, the point is they set something up that was potentially dangerous to another person (and in this case was).....I say charge them, with the most severe charge possible.

Don't coddle the little b1tches.

I agree. They need to be punished, but what they did was negligent, not malicious. Ruining their lives over this will not serve any purpose. I think their attitude about the situation would be most telling with regard to whether they are likely to do something so stupid again.

well then lets prosecute mcdonalds sony and toyota
mcdonalds leads to heart disease
sony creates exploding batteries
toyota has to recall a bunch of scions

what they did hurts thousands and they get no punishment...

It sounds like something I would have done. I don't believe it was meant to intentionally harm someone. You have to look at the intentions when determining the punishment. Throwing the kids under a bus doesn't fit the crime.

I couldnt help but to laugh out loud when I read this. I just pictured some woman walking by and a shopping cart falls from the sky and lands on her.

and the difference is what? each party had one idea of what they were doing and it resulted in an outcome they didn't foresee

Wow, what accurate comparisons. Can I run all of my major life decisions by you first, because you obviously know what's going on.....

A more accurate comparison and question would have been this. Lets say you filled a bag full of firecrackers and set it on top of a hill. Now, theres a bunch of picnicers below and you want to light the firecrackers to scare them as a prank. From the start, if you have any intelligence at all, you'll know this "prank" could be potentially harmful to another person, but you do it anyway, disregarding common sense, for the sake of a good laugh.

You light it and run away. Now, up strolls a toddler and he goes straight for the bag. You're long gone to do anything about it, and the fuse has already been lit. The kid suffers major injuries as a result.

Your negligence, and pure lack of intelligence, led to that kids injuries. You should be punished accordingly.

Now, I do agree with Mugs the more I think about it and think it's more negligence than them being malicious. But if they set this up KNOWING it very well might fall and seriously hurt or kill someone....then I say serve em' up some ass beatings and jail time.

With McDonalds you chose to eat there knowing the food can, overtime, lead to heart disease.

With Dell, they didn't send out the laptops KNOWING the batteries would explode and as soon as they found out they made a recall.

I won't even bother to go any further in poking holes in your logic.....I doubt you'd listen anyway.

WOW, some serioulsy bad logic flying around today. Comparing a prank to manufacturer defects? That hardly applies. McDonalds has been sued, many times. Because the prankster intended no harm there should be no consequences? That is just absurd. To carry out the prank, the pranksters had to break the law - trespassing, vandelism, you get the picture. That it resulted in injury makes them liable for damages. Consequences are for actions, not intent. A prank by definitaion is intended to cause some type of harm. This is not an accident, the prank was intentional, so intent does help here. We don't have thought police yet, despite Republican party efforts. Where would we be if we never held anybody accountable for their actions because they believed their intent was good.

lack of reading really makes people come off as ignorant.

they should be help liable, yes, like i said. but they weren't meaning to hurt some body, atleast not this bad. im saying that giving these kids the harshest penalty out there is going to solve anything, if anything it will create a bigger problem, its like throwing gasoline on a fire to put it out...

The cart fell Saturday as the woman untied the rope to raise the flag, as she did every day when she went to work

I would imagine, after going out there every day you grow accustomed to going straight to it and starting the rope untying process. One could resonably expect to think there's no need to look up since what are the odds something will be up there? right?

How is that hard to imagine she went out and did what she does daily without looking up?
