I don't know about the "legality" part. Moreover, nobody I've heard of even cares, seperated is seperated. Whatever you do then ain't considered cheating on your wife - you're already seperated. I think those who believe otherwise are a small minority.

It's not a matter of which mistakes are excusable.

It's mostly a matter of "old news", he wasn't even a politician then IIRC. That and the fact he's been married to his current wife for almost 30 yrs w/o incident. If McCain were found to have been cheating on her back in 2006 it would be equally damaging to him.

BTW: 40yrs old is considered pretty young by many people.

Ok, so let's clarify then: McCain had extra-marital affairs with a number of women before he separated from his first wife, but didn't file for divorce until he wanted to marry Cindy which was after his separation. There, that sounds much better.
