Well.. I'm just going to go ahead and address the 500 lb gorilla in the room - now that a Supreme Court Justice seat is up for sale to the highest corporate bidder, how will this impact the current election?

Sorry bro. The black man gets to have another one.

RIP

I didn't find him to be a good SC justice. Mostly because of how outwardly political he became and how his opinion on how strictly the Constitution/Bill of Rights should be applied constantly shifted based on what case was being considered. But, in any case, RIP.

And I'll be surprised if Obama can get anyone confirmed, but we'll see. The Senate used to be more reasonable than the House, but Ted Cruz is a senator so...

He was obviously partisan and not the most amazing judge, but he defended gun rights against the growing libruhl menace and that makes him praiseworthy enough. RIP.

I'm calling it right now; this will be an election to remember! This election season so far has been relatively tame, that will change. If the dems can't get out the vote then I expect a tea party like revolution on the left.

glad he got to kill some small defenseless birds before he went to oblivion. Everyone should be able to satiate their lust for death one last time.

I don't know but they just need to delay him until next year.

As another poster just said, shit just got real!
Yeah, Congress tends to draw out the nomination when they're not keen to the President's pick, probably in the hope they'll drop out. No one likes the idea of voting against a Supreme Court nomination, however.

That cant outright stop him can they?

There's no way in hell Obama is going to get to appoint Scalia's replacement.

There are 81 Federal Judge/Justices positions vacant. About half have pending nominations that have been pending for 1 or more years.

The GOP controlled Senate can easily stall until summer recess(August) without much effort(ie: never having to vote against confirmation and not having to use the nuclear option). Since it's a presidential election year the Senate won't meet much at all once they get back from Summer Recess, until after the election.

Those are different yeah? I really dont know how it works. It seemed his last one went through pretty quick. If they can hold shit up like that why didnt they last time?

Theoretically, the Senate could refuse to confirm a nominee as with Robert Bork but I doubt Obama will nominate anybody who's nearly as controversial.

McConnell is too smart to play the obstructionist in a presidential election year, I think. It's bad for business & bad for the Court to leave open the possibility of a 4-4 tie.
