He will appeal because he strongly disagrees with the court. He just has to figure out where to take the appeal.

Not when you break the law. He attempted to go from doctor to doctor and get prescriptions to fulfilled at various pharmacies which is like a crack head going from corner to corner to get a score. That is breaking the law. Rush is a criminal and in the end his fat rump is going to jail. And I can asure you he won't get a nice cell like Martha. He better have one of those wash cloths where the soap lathers on its own, LOL 🙂

He was on the radio today whining about the decision. Apparently one justice voted his way, so obviously he points out that. He's going to jail and thats that.

How can one have a drug problem and not break the law when nearly every symptom of having a drug problem has been made illegal? I'm not excusing his behavior, nor am I saying it should go unaddressed, but people acting on afflictions are not the same type of criminals as those acting on motives to intentionally and/or actively victimize other people. This is what deserves jail time, drug problems deserve treatment. I don't like Rush one bit, but I like government picking on people even less.

True but personally I hope he is punished because he is a hypocrite on a national scale. Your everyday crack-addicts don't get treatment, so I think he should join'em since he thinks they are so morally culpable. Basically, it's poetic justice. 🙂
 
Disagreeing with the court is not a basis for an appeal. Remembering an argument that you forgot to raise at trial is not a basis for an appeal. You have to be able to show that there was some sort of error in the lower lever proceedings. (Matters of law are appealable; matters of fact are not appealable.)
 
He won't go to jail unless he's convicted in Federal Court, and even then he could get probation. He's likely to get probation here in Florida Circuit Courts as well. They'll probably withhold adjudication. That's the worst he's facing from the system. The fallout from his conservative audience might be more to worry about, although conservatives have almost no ability to smell hypocrisy.

I agree with Shelley, of course. Drug use and abuse is a medical problem and shouldn't be in the court system except in the rarest of cases. 54%, if I recall correctly, of federal inmates are there on drug charges. Sheezh, talk about a waste of taxpayer money for a hopeless cause. The war on drugs is little more than a federal make work program.

Dunno where it's all going, but Rush should get some kind of msdemeanor/probation rap- first offense, and all that. Dunno about Florida, but in Colorado, deferred judgement is usually invoked only for minors. Cop to a misdemeanor, take probation as recommended by the prosecutors, unless the judge pops wood for ya'...

Maybe a year of work release- he'd learn a whole lot about the incarceration machine that he seems to love so much...

Although I think the drug laws in their current form that punish addicts are a stupid waste of taxpayer money I really don't feel a bit sorry for him in this case. He's getting a taste of what his pompous narcissistic ass has been dishing out to others for years. The big 'ole right wing govornment he has been promoting so long has got his ass. He tried to pawn the whole thing off on an immigrant housekeeper too if I remember right. He could use some time in jail. It will be good for him to rub shoulders with someone outside his yuppie white neocon culture. I watched his show once...not a single black person in the audience. You need to stop and question yourself if you find this in your show. He gives white males a bad name.

I agree in the abstract, but this is a guy who's specifically argued that affluent, white drug offenders shouldn't be above the law, and that all drug users should be deported. It wouldn't bother me to see him get hammered.

First, you might need to change your Free Stern. Second, what type of prison would he be sent to. Hard time or Martha Stewert time? It would be pretty to justify anything but hard time for a drug offense.

Rush should, IMO, be treated like any other Floridian offender who possessed, used, and solicited distribution of massive amounts of controlled narcotics.
 
I think a Rush conviction and prison term would actually damage the reputation and good name of the Republican party and thus damage the fabric of American values. For that reason alone, if for no others, he should get a pass and not be prosecuted. There is just too much at stake, too many people whose illusions would be crushed. A conviction, I think, could actually lead thousands, if not millions, to be tempted to use drugs too, not only to ease the pain of such broken dreams, but as a sort of ditto act of support. I don't think we want to put the country through that. I for one forgive. You really do need to cut prominent white people slack because they are the backbone of the nation. Even God had his Prodigal Son.
