The rules on classified information are quite clear.

And I just don't understand what the newspaper had to gain by releasing the name of a CIA operative.

For the same reason that Bush doesn't have charges against him for violating the 4th Amendment with his illegal searching of people's personal effects, namely their phonecalls.

I don't care if they're dems or repubs really--I would just like to see more egalitarianism in the justice system. For example, the enron execs--they were found guilty yet they are allowed to stay out of jail on appeal--that doesn't happen with ordinary citizens.

They're not out on appeal. They're out pending sentencing.

A judge on the United States Court of Appeals for the Fifth Circuit in Houston ordered them set free on bail until a decision is reached on their appeal. --NYTimes

Here is an example in the Enron case where the guilty (and sentenced) are released from jail until an appeal decision is reached.

If the prosecutors had any sort of evidence against him, he would have been charged. Considering that he wasn't, the case against him had to be very weak to non-existant. So it is good news for the American Way. Then again, it's Rove so guilty until proven innocent, right?

I would much rather have Howard Dean screaming like a maniac than have Dubya pissing on the Bill of Rights and taking the national debt and corruption to new levels.

What's evdience got to do with it?
Charge him based on heresay? That would get the indictment laughed out of court and weaken any ondoing investigation.
