Rescinded Job Offer 3 days before starting...

Taking it to the court of public opinion could undermine the OPs ability to get hired for future work and could invite a SLAPP lawsuit from the company he is "discussing". So could be double loss for the OP depending on how the company reacts.

Not if it's true. And it's not like he has to reveal his real name in the blog. The worst they can do is a cease and desist.

I'm sure many other potential job seekers would appreciate it as well. Let the world know about this asshole company. A good start would be in this thread. 😉

You are right. Its just a worst case scenario sorta thing regarding a SLAPP.

However, the OP will need to keep his credibility intact and blogging even without mentioning a name could damage that. He has to make sure his online "brand / image" is positive and squeaky clean for those future employers who are looking to hire him.
 
California is an "At Will" state, so unless he has a contract signed by the company, he's SOL.
He has no case unless he's incurred actual damages relative to the action. If he gets nailed for the lease, he can sue, and should, though Small Claims may be the most expedient, Superior Court would be a waste of money,imo.

Welcome to Free Market Capitalism. This sort of shit used to happen to me a couple of times a year with tours and still sucks. There are far more shows booked and canceled, than actually play.

Update: Friend interviewed some more and got other offers. Original company comes back and tells my friend the position is available now and there IS funding. He counters with his other offers and got more than he was offered originally so he took it. Hopefully the company doesn't rescind their offer again. If they do, he has backup offers just in case.
 
CA is right to work state(for now) so they could agree to hire him, let him work two days, and then fire him saying it's not workingout...

That's good news. I bet he's glad he acted like an adult when the job slipped from him originally.

Then he called it off

Then she sued for damages . . . and won

Even if it's legal for the company to fire/not hire you (just like it was legal for the guy to cancel the wedding), it doesn't mean you can't be held liable for damages

According to him, he signed and agreed to the job offer before even planning the move. I guess companies can screw you either way. My question was why would the company even offer the position when they didn't have the budget for it. Don't they waste alot of resources interviewing candidates and flying them down for onsite interviews?

happens all the time. sometimes they suddenly no longer have the budget that they thought they had. or could be many reasons and situations that allow this.

signing him on though, and just before the move...that is totally fucked up.

Well they did reimburse him for any travel fees after they rescinded the offer. Friend was really devastated but picked themselves up and talked to the HR to make sure that he was still interested if the funding would ever show up.
