<< And since Me "Lee" is never identified by name or address, I highly doubt this is going to "ruin" him. >>

Ah,,I thought some of you would bring this lame arguement up. Phongs (not his real name) street address is clearly displayed on the mailbox photo. The realtors number is also visable. There are photos of Carlos and his full name idenifying him at the site. Wanna bet I can find out who Phong reallly is in about 24 hrs. and I'm way out in California.

The fact that it would take extraordinary effort on your part to figue it out negates your argument.

BTW, in what photo is the address "clearly displayed?" In what photo is the for realtor's number visable?

[edit] I see the street number in the last photo. Yet, what street is it? And I still do not see the number of the realtor.

The number's been blurred (in this photo) since this thread was started. Looks like Carlos is aware of this thread. 😉

Extraordinary effort?

Google, then Assessor for Muscogee County, GA. It isn't *that* involved.

edit: Looks like this photo still has the house number. Oopsie, one fell through.

what the hell does it matter? his neighbor is a frickin crackhead....what would it matter if all of his information got posted on the site??!!!! who cares if people them, or find out??!!! they deserve to get slammed for that sh*t...

Yes, it was plain as day.

Libel and slander are legal claims for false statements of fact about a person that are printed, broadcast, spoken or otherwise communicated to others. Libel refers to statements in written or other permanent form, while slander refers to verbal statements and gestures. The term defamation encompasses both libel and slander.

In order for the person about whom a statement is made to recover for libel, the false statement must be defamatory, meaning that it actually harms the reputation of the other person, as opposed to being merely insulting or offensive.

The defamatory statement must also have been made with fault. The extent of the fault depends primarily on the status of the plaintiff. Public figures, such as government officials, celebrities, well-known individuals, and people involved in specific public controversies, are required to prove actual malice, a legal term which means the defendant knew his statement was false or recklessly disregarded the truth or falsity of his statement. In general, private individuals must show only that the defendant was negligent, that he failed to act with due care in the situation.

A defamation claim will fail if any of these elements are not met.

The primary defenses to a defamation claim are that the statements are true, are statements of opinion or otherwise not statements of fact, or are privileged. Truth and opinion are complete defenses to a defamation claim. In addition, some defamatory statements may be protected by privilege, meaning that in certain circumstances the interest in communicating a statement outweighs the interest in protecting reputation. For example, many jurisdictions recognize a privilege for media reports of government and judicial proceedings, and for reports of misconduct to the proper authorities.

A successful defamation plaintiff may be entitled to a jury award of money damages. In some instances, the plaintiff may also be awarded punitive damages for particularly reprehensible conduct. The parties to the claim are entitled to appeal and cases are carefully scrutinized on review to protect the defendant?s First Amendment rights.

Defamation claims can be brought by living persons and legal entities such as corporations, unincorporated businesses, associations and unions that are considered "persons" under the law. Governmental entities cannot maintain actions for libel or slander, although a government official can bring suit for statements directed at them individually.

Libel and slander are civil claims, but about half the states recognize an action for criminal defamation. Prosecutions are rare, especially against the media.

Under the American federal law system, defamation claims are governed by state law, subject only to the limitations imposed by the free speech and press provisions of the First Amendment to the U.S. Constitution. While the elements of defamation are practically identical throughout the country, because defamation is a matter of state law there are important differences on substantive and procedural details of the claim in the separate jurisdictions. For example, states can, and several do, provide heightened protections against defamation beyond those required by the First Amendment.

Extraordinary for some living in Ca? not at all, a simple call to the planning commision or recorders offfice with Carlos Name Get that street adddress then ask who owns the adacent homes.

If we lived in Columbus we would probably know Carlos or someone on that street and it would be even easier.

I understand what you mean by public hummiation and also thought the page was funny intially, but it's also not the way we do things here (unless you moslest children).

It's the quiet neighbor that you guys should pay attention too. You know the type, very quiet and very harmless and never bother anyone.

Speak for yourself. If someone stinks. Let everyone know. If someone talks loudly in a restaurant, humilate them. Some things NEED to be publically humiliated. There ARE social standards that are upheld through social stigma rather than law. One of these is the appearence of your property. Trust me, you want your neighbors humilating you rather than being thrown into jail for not mowing the lawn.

Columbus has ~190k people living there. The way you're going through this thread I don't think you're that popular. 😉

I don't have a probelm with this notion on a "immediate vicinity scale", after you have asked them to correct thier behavior. But posting this for all of Columbus to see can only permanently harm the Phongs chances of living in Columbus without prejiduce. Be it running thier business, going to resturants, of buying another home.

What are you smoking? What does child molestation have to do w/anything? Also:

<< ...can only permanently harm the Phongs chances of living in Columbus without prejiduce >>

Got news for 'ya, Mr. Rocket Scientist; the way this guy keeps his home ruins his chances of living ANYWHERE but a slum trailer park. He has successfully:

1. Burned his patio table
2. Burned his patio
3. Burned his backyard
4. Almost burned down the neighbors' homes
5. Made a decent house look like a shambles w/random acts of "carpentry" and "masonary work"
6. Had the police called out to his home on multiple occasions for loud music and public disturbances at 2:00AM
7. Had fistfights at said parties
8. Attempted to raise livestock in his backyard

And that's just what I remember off the top of my head, w/o rereading the website. The guy is not only a major nuisance, he is a physical danger to the entire neighborhood and his neighboors. He needs to go.

Ditto. I couldn't help but think how similar this was to reading a typical Dave Barry article. Can you imagine how funny Dave would have made this whole scenario with his comedic writing skills?
