Kerry to Enter Ohio Recount Fray

2004 Democratic Presidential candidate John Kerry will file today, in the United States District Court for the Southern District of Ohio, papers in support of the Green Party/Libertarian Party recount effort. Specifically, Kerry will be filing a request for expedited discovery regarding Triad Systems voting machines, as well as a motion for a preservation order to protect any and all discovery and preserve any evidence on this matter.

Triad Systems has come under scrutiny recently after Sherole Eaton, deputy director of elections for Hocking County, swore out an affidavit in which she described her witnessing the tampering of electronic voting equipment by a Triad representative. Rep. John Conyers, the ranking minority member of the House Judiciary Committee, has requested an investigation into this matter by the FBI and the Hocking County prosecutor.

Truthout will have more on this specific Triad allegation later in the day.

Previously, the Green Party and Libertarian Party have not fared well in their efforts to get emergency orders regarding this matter in Ohio. In order to pass muster with a judge, the individual or group requesting an emergency order for such a recount must show both irreperable harm as well as a substantial chance for success on the merits. While Green and Libertarian representatives have been able to show irreparable harm, they could not establish a substantial chance for success on the merits, because no recount would deliver Ohio to either party.

Kerry's entry into this recount effort changes the math on this matter dramatically. He can likewise show irreperable harm, and unlike the Green and Libertarian candidates, he can also prove a substantial chance for success on the merits because he lost the Ohio vote by a statistical whisker.

It should be noted that Kerry's filing of these requests does not indicate his complete entry into the recount process, but does clearly indicate that he is moving decisively in that direction. His previous stance on the matter was based simply on his desire to defend the right to have a recount in the first place. The evidence of election tampering in Ohio, specifically surrounding Triad, has motivated him to actively join the fight. The Democratic Party is also quietly putting financial resources into the Ohio recount effort.

Perhaps the most significant aspect of all this, from the activist point of view, has been the effectiveness of the telephone calls and letters to Kerry. The activist push to get him involved had a very significant effect on his decision to enter this effort. Likewise, calls to other Senators in order to convince them to join House members in challenging the election have likewise had significant effect. If such an effort continues, the activists involved will very likely see the desired result unfold.

Very interesting development

This has to do with the story of voter fraud conducted by Triad System employees in Ohio in which they entered election offices and tampered with the computers running Triad proprietary software then instructed election workers how to conduct a recount that was guaranteed to match the original count.

What is Katherine Blackwell hiding???

Personally, I don't like recounts. If it were like a 1,000 vote difference (or even 5,000), then we should probably check things out. But with the spread here, the only thing you can do is divide the country. They are going to turn up voter fraud (I guarentee it) and it's going to cause squabbling. Nothing good can possibly come from this because we all know that the green party leans left and are looking for fraud by republicans. We all know that they will ignore left fraud.

OMFG! KNOW I KNOW WHY EUROPE SEES US THE WAY WE DO. they are definatly superior to us educationaly.

COLUMBUS, Ohio - An attorney behind a presidential election challenge dismissed earlier this week asked a different judge on Friday to make Ohio's top election official answer questions about the Nov. 2 vote.

Attorney Cliff Arnebeck asked a federal judge to allow a group he represents, the Massachussetts-based Alliance for Democracy, to join a complaint filed against Secretary of State Kenneth Blackwell on Election Day.

Federal judges ordered election officials in Franklin and Knox counties to do everything possible to help voters in long lines on Election Day after the Ohio Democratic Party filed the complaint. In December, Democrats asked U.S. District Court Judge Algenon Marbley to dismiss the case.

The filing Friday asks Marbley to allow Arnebeck to take Blackwell's deposition on an emergency basis.

"The aim of this is to get to the truth as fast as possible and have anyone held accountable who committed any illegal acts or fraud," Arnebeck said.

In court filings, Arnebeck alleges that Blackwell helped execute a plan to create long lines in Democratic precincts and other voting irregularities to help President Bush win.

Many of the allegations in Friday's filing are similar to those in a challenge brought by voters seeking to overturn President Bush's victory. The Ohio Supreme Court on Wednesday dismissed that challenge after the 37 voters, who were represented by Arnebeck, asked to drop the case.

Arnebeck tried to interview Blackwell in that case, but the secretary of state avoided giving a deposition by requesting a protective order.

On Friday, Attorney General Jim Petro's office said it would wait to see how Marbley rules on Friday's filing before deciding how to respond.

"Courts are serious places for serious people, and Mr. Arnebeck is not a serious person. His filings are frivolous, without merit and not based in any sort of reality," Blackwell spokesman Carlo LoParo said.

A message seeking comment was left Friday evening at the office of attorney Kathleen Trafford, who represents the Ohio Democratic Party.

President Bush defeated John Kerry by about 118,000 votes, according to a recount of the official results. Ohio's 20 electoral votes gave Bush the 270 he needed for victory. Kerry conceded the morning after Election Day.
