Sue the school for negligence and damages. This is what you do in the USA.

Except that if the school is public, it is probably protected from suit by sovereign immunity. Unless there is a statue specifically allowing the school to be sued in the circumstances described by the OP.

yeah but i live out in the farming area. nearest "town" is 25 minutes away.

Rockford is the closest large city and the few private schools are "out of district" bah. Also they score lower then the school she is in.

i like the school she is in. The Education she is receiving is great. Having on average 9 kids in each class really helps. not to mention the teachers push the kids to be there best.

I do think they need a little more training on other things. the administration just does not seem to fallow procedure.
 
There are a lot of people in this thread that need to spend a month in a typical public elementary school as an adult rather than judging them by what you remember as a child. What the OP's child experienced is far from the norm, at least in the system I work in.

That's the thing. Your school system probably is managed a little better. As a parent, I've had my kids in ... let's see ... five now? Yes, I think five different school districts across three different states. Each district is very different in pretty much every facet of it. Where my kids go currently, I'm fairly certain the teachers don't give a shit about the kids and are just busy making their education quotas to meet state goals. Almost drone-like, as if the day would go on whether there are children in the seats or not.

The previous school district we moved from actually cared about the students, their education and their well being. The district before was a private school, so they were paid to give a shit. And before that was a public school, which was more concerned with making education the parents' problem.

I really hope that the OPs experience is far from the norm, as I've stated earlier, it is somewhat crazy to go for so long without any sort of medical attention. Limping + crying should have been the first sign that something might be wrong.

I should state, that I'm by no means a nanny state supporter. But when it comes to someone being responsible for another persons kids, medical problems should have a pretty high priority. (and I mean real medical problems, not "Everyone needs a hand sanitizer" type garbage)
 
Rather than sue the school, make a compromise. A pediatric wheel chair would have been invaluable in that situation. Ask the school to purchase one in the event that this situation occurs again. Perhaps have designated staff members certified in first aid or BCLS, if that hasn't already been implemented.

I think that's a great idea. Although with the way most schools are over budget and suffering numerous cuts, I don't think spending money on a wheel chair or certification training are things a district/school could afford. It definitely wouldn't hurt to start with this though...
 
I just don't think either party could really afford lawyers. If this was settled, paying legal fees to attorneys seems like a waste when you could have solved future situations for a lot less.

Unbelievable. I'd be freaking furious. Totally unacceptable and grounds for legal action imo.

The school will never say sorry because that admits a fault which leaves them open for you to sue. So you'll need to persue it yourself.

Wife is a buss driver for the school. the head of the school asked her why we called the Superindent. he yelled at her for a while. When asked why she called them she said she didn't that I did (wich is true) and he said i had no right to do taht.

He is also claiming the accident happened at lunch recess and he knew but thought she was faking it (even though other people said it happened on morning recess).

bah the jerk does nothing but give us the run around. I'm not looking to sue all i want is to know who fucked up and why it happened.

Wow someone has the nerve to get pissed off at you and your wife? At this point I'd be raging pissed and would be phoning the local paper and a couple of lawyers.

Sometimes a good knuckle sandwich to a weasel's head is well-justified.
 
You really should escalate this. Your daughter should be fine from a broken bone but there are plenty of things that could happen where a kid wouldn't be. A fall on the playground that could cause a head injury or a kid sharing his lunch with someone who happens to be allergic to something could easily turn into a very serious issue if the adults there aren't observant of what the kids are doing or willing to listen to what they're saying.

It sounds like you've got a good attitude about it but you should go ahead and see about escalating the issue. You can try the PTA, the district and possibly even a member of the school board. If you go talk to them as a concerned parent (rather than the crazy yelling rabid kind) you'll have better luck.

EDIT: I finished reading the thread, sounds like you're working on it. If the head of the school refuses to admit that there's a problem it means that there is a SERIOUS problem.

Why dont you call the superintendent back and explain that your wife was wrongfully yelled at over this situation in the exact detail you made in your post.......?
