question about software sales

i see ppl selling "oem dell/hp" os cd's in fs/ft. i was under the impression that these cd's were nfr. am i wrong?

so back to my original question... is an OS restore cd from dell is marked "for distribution with new dell pc only", is it classified as OEM or NFR?
 
I would think if it states that then it is NFR unless you are selling the PC it came with. If there are no specific statements then it is OEM.

the os restoration disks that come with dell look nothing like an authentic windows os cd. while the windows xp cd is sort of holographic, the dell os restore cd's are usually a solid color (i've seen green, purple, and dark blue). they also have some text on it saying it's a dell os restore cd and blah blah blah.
