Hope the city has budget for the payments it's going to be making on this one... If the story holds up pretty much everyone he is suing is going to lose. The Hospital is going to take it up the ass too.

Yet another reason for police officers to pay for "malpractice" insurance through their union dues. This way, when they harrass the citizenry or abuse their powers and are convicted of it, the cops will be paying for it where it hurts, instead of the taxpayers.

How about they have no right to subject him to radiation just because he's squeezing his ass?

That would certainly be my preference. That's why I asked what happened between the time he was pulled over and the time he exited the car.

The point was that once they had a clear x-ray, no further search was in any way justified.

I sincerely hope and pray that I am proven wrong in this, but speaking pragmatically;

He's not going to be rich. He's going be taken to collections for outstanding medical bills related to these illegal procedures after blowing any savings he may have trying to fight city hall.

Cops and judges will close ranks on this and the "Blue Code" will prevail.

Shitty as that may be that's life in today's America. We are talking about the same country that now willing to suspend habeas corpus, lock you up and throw away the key indefinitely for activities that may or may not suggest involvement in terrorist activities to include, but not limited too:

- Having Burn Marks
- Missing Limbs
- Acting Nervous
- Making Large Purchases using Cash
- Extended Rental of a Vehicle
- Taking Notes
- Making Maps
- Interest in Radio Controlled Planes
- Wearing Backpacks
- Taking Video
- Making Anti U.S. / Anti Government Statements
- Stockpiling Ammunition
- Lack of Facebook/Other Social Media accounts/Cell Phone
- Having More Than a Seven Day Supply of Food

...and that's just barely getting into it

Been through a "suspicion-less" Nazi *ahem* er.. I mean Border Patrol checkpoint lately?.. See if you're not treated like a suspect? They ask to look in my trunk ALL THE TIME because I choose to drive an old piece of crap honda that admittedly might look like a drug runner's throw away car, but so what what it looks like? That alone is not P.C. to want to search my stuff but they do it anyway! The mass spying scandal that Edward Snowden leaked on? As if that's not been going on since the dawn of time. But "hey, I've got nothing to hide so why should I care?" is the pacifist's cry while EVERY DAY your rights are being TRAMPLED!

Well, THIS incident in New Mexico is a perfect example of why you should care even if you have nothing to hide. It's the point of the fact and as I said before I truely hope and pray this guy takes them all to the cleaners and wins out. Sadly, I don't hold out a lot of hope.

Yes it has gotten THAT out of control in this country and it's going to get a lot worse before it gets better. LEO is out of control! The ever more militarization of our Police forces and the brazen trampling of basic human rights. When is enough going to finally be enough!?

I wasn't pro-sue the doctors, not necessarily because they're free of any culpability, but more because they were following the policeman's orders. BUT, after seeing that they threatened to send him to collections for not paying for those procedures??? Okay, sue the hospital too.

The hospital should have had someone reading that warrant, to be sure they're in strict compliance with it. Failure to do so constitutes malpractice.

Threatening to send him to collections is just adding insult to injury.

The had the warrant. The warrant clearly was not valid, but yet they followed the orders anyways.

The reality of the situation is the Hospital and Dr's are liable for just as much damages as the police, if not more.

That is not exactly true. The DA/State/Feds have to prove more likely than not that the property is being used in criminal activity for an item to be forfeited. IE: They have to go to court to keep the items. It has to be more than an assumption.

The overwhelming majority of asset forfeiture cases are legit.

This raises the question of who does these cavity searches under more normal circumstances... If doctors do this routinely there must be some legal framework that:

A. Compels the medical profession to do this under court order,

B. Some form of legal protection for the medical people should the court order not be sufficient/valid,

Obviously, there are a lot of criminals and prison inmates that get there ass searched with some frequency and someone must be doing it so logic dictates that if doctors are doing it there must be some set of legal provisions that compel them to do so ... one would think. If so then the docs are probably off the hook here unless they performed the procedures in a way that could expose them to malpractice lawsuit.

It may be the case that the multiple enema and xray treatment is bad medical practice and that would be the issue exposing the doctors not that they followed a faulty court order.
