In an ongoing war of words, Senator Brown has responded rather angrily to Biden's assertion that he should get his facts straight about legal representation in military trials.

For those who don't know, Scott Brown has been a military lawyer for decades and according to Politico is the Guard's top defense lawyer in the New England region. In other words, he is the lawyer Biden is asserting that military trial defendants don't get.

Even if you automatically consider yourself the smartest man in the room, it never hurts to actually know your opponent - or to at least know what you're talking about.

I dunno, I think Obama chose Biden not for gravitas but as cannon fodder, sort of the ugly friend a semi-hot girl drags along to make herself seem really desirable. Pretty much anything Biden says is going to make pretty much anything Obama says sound intelligent.

That's the problem with bringing along a hot chick; whatever you say just annoys people trying to look at the hot chick. Also Palin is way smarter than Biden. Also McCain is mostly liked by people who point him out as a good Republican - but the Democrat candidate (whomever he or she may be) is just so darned good. Also McCain is way dumber than Obama.

As senseamp noted, this is an interesting quotation from an attorney who knows that defendants in military tribunals get military-paid lawyers to defend them.

Perhaps our newest Senator was too busy pandering to the Palin wing of the GOP to bother with accuracy...

Are you advertising your own density? Vice President Biden was criticizing Senator Brown for the Senator's implication that military tribunal defendants don't get representation.

Military lawyers get paid either way; they are appointed as they become available. Civilian lawyers are paid with tax money above and beyond that allocated to military lawyers, and in a case like this would be much more highly paid - I think the figure in the news was over a million dollars per trial. Civilian trials with civilian lawyers require millions more in tax money to stage. Either way the defendant will have representation; it's just a question of military lawyers versus subsidizing another rich Democrat constituency by hiring civilian trial lawyers.

Brown being a military defense lawyer himself you would have to have the density of lead (i.e. Biden) to not understand his point. Biden clearly has that density; I leave it to you to prove your own condition.

Vice President Biden never said or implied that military tribunal defendants do not receive representation.

My understanding is that unless war is declared, terrorism is treated as a crime and thus defendants receive all the protections of the 5th amendment. I'm not sure if a Constitutional legal framework exists for military tribunals without such a declaration. If anyone knows otherwise, please provide sources.

Your basic premise is bass-ackwards, werepossum. Biden asserted that defendants *do* have attorneys in military trials, not vice versa. Start by getting your own facts straight. Biden's assertion is perfectly accurate. Brown's assertions and experience wrt to the UCMJ are meaningless in the context of the kind of "Military Tribunals" envisioned by the the Bush Admin. It's not the same, and he knows it, even says so. He's pandering to bloodlust.

Brown is just trying to beat the usual rightwing drum about trying terrorist suspects in military tribunals. Righties luvs their authority and symbols of authority, so they lap it up, just as they lapped up the whole raison de etre for the prison at Gitmo. In their minds, "Military Tribunal" means rubber-stamping the accusations, moving on to the revenge, the good part, just like in the Movies. Dub and Dickie said it was true, so it must be true, right? A "real trial" is too good for 'em...

Afraid not. If we're to maintain any sense of self respect at all, any allegiance to the whole concept of justice, the the trials of terrorist suspects must proceed pro forma, by the book, with them having every right afforded to any party accused of a crime. Just slapping a Terrarist! label on somebody doesn't mean the govt doesn't have to make their case, at all.

Maybe McVeigh should have been tried by military tribunal, huh? He was every bit as much a terrorist as KSM is accused of being...

Exactly, this Brown idiot wants to have it both ways, pander to the right wing and then act like he knows the law too. Well, if he knows the military law so much, he should know these guys get paid representation at military tribunals, so he's either an ignoramus or a liar.
