In both games nVidia had no access to the source code of the game prio the launch. That is one point of AMD's accusation:

TressFX was published after Tomb Raider. It was a lock out of nVidia.
And Mantle runs only on AMD hardware. And with "full control" of the API AMD can easily "lock put" or harm any other partner with unannounced changes in the API after they "opened" it.

BTW: Name one Gameworks game which locks out AMD from optimizing for it.
You cant critize Gameworks for locking AMD out when you are still behind Mantle. That doesnt make sense.

dios mio! mantle and gameworks are literally 2 different things, 1 an api and the other an effects library/middleware, hell it would be technically possible to implement gameworks in mantle - if AMD could get the source that is.
What you are doing it create a false equivalency to stretch this paper thin argument

No, I don't think you do.
If you did, you would know that what needs to be open about it is open.
Freesync is radeon hardware and catalyst software to offer variable refresh and asociated benefits using Adaptive Sync.
There's nothing about freesync that needs to be open.

NV gives a free option to help users = villain
AMD locks-out others from using mantle = perfectly justified

FreeSync is still in a development phase. It hasn't even been released yet! How can it possibly be "open" or "closed" if they're still working on it?
