Ordered 80 gig WD HD per outpost website. URL clearly does NOT SAY OEM drive.

Downloaded 75 dollar outpost rebate

Did all this within rebate specific timeframe.

First they sent an OEM drive. Rebate specifically calls for sticker from retail box; impossible
First lady at outpost customer service told me nothing could be done as I bought an oem drive. She told me to call western digital to see if the rebate would be honored . WD told me the rebate was through outpost and need to speak with outpost.

Second person(call) to outpost I got a knowledgable person Outpost.com 80gig WD drive and rebate IS A SCAM PLEASE READ MY EXPERIENCE

<MFrasca@outpost.com> who told me outpost had had a drive shipment error and that they would send the retail drive immediately. I drove to the post office and sent them back the first one.

Today the SAME F----ng OEM drive came again.

This time Marc told me outpost is unable to send the "correct retail" drive they had promised.

I believe this is clearly "fraud" They get you to order the drive using the rebate as bait then send a different, rebate non applicable drive.

They hope a few suckers will just say hell with it and keep it.

My next step is to share my information/records with the FTC and with the state attorney general in outpost applicable state. Would anyone know which is the correct state? Apparently they have a Ohio, and California address.

Anyone wishing to contact me may do so steve96822@hotmail.com

<< 1. Brag and Moan thread or Off-Topic.

Highly applicable since it pertains to VERY HOT topic; WD 80 gig drives

2. It's not clearly "fraud".

Which year were you admitted into the Bar

3. Lay off the crack pipe.

I leave that to the "techies"

You DID pay with a credit card, didn't you?

If so, dispute the charge with the credit card company, telling them the whole story.

Also, don't bother with the level 1 "support" people at outpost.com, ask to talk to a supervisor.

I suspect that beings Fry's Electronics bought outpost.com, any semblence of competence will be rooted out, like at Fry's.

My last two orders at outpost.com were cancelled by outpost.com because, after I placed the orders, they decided not to cary the producs anymore. I'll shop elsewhere.

file a claim with your credit card company... It is over $50. Tell them you were sent the wrong product.

It would be fraud IF you could prove they are purposely doing this in hopes some people just say the heck with it and give up on the rebate. I would suggest you go ahead with the FTC complaint. If they get enough of them then they will have proof of fraud, especially if Outpost continues to lead people to believe these are retail drives after the mistake has been brought to their attention. To the person who just our-of-hand dismissed this as even possibly being a fraud, you need to face reality. There are thouands of businesses who knowingly put out incorrect ads and attempt to cover themselves with the tiny "Not responsible for typographic errors" disclosure at the bottom. This has been going on for years. And so the same type of thing is being done on the internet now. Whether or not that is the case with Outpost, I don't know but it is certainly being done routinely by many others. Anyway, I think the key in the case of rebate deals is to ALWAYS make a screenshot of the product page and make sure that screen shot captures the date somewhere. That way if they later change the "typographical error" on the website you have proof of what it said at the time you placed the order. You can then hold that over their head to make good on the deal or threaten to both dispute the charge and file the FTC complaint. Most of the time knowing that you have the evidence to successfully do this will motivate them to come through.

I simply sent it back. After my thread of emails with them I doubt they will contest charges.

I am awaiting a supervisor call back. The level 1 customer service (Marc) was courteous and immediately said he would correct the problem and sent the correct drive.

I suspect the questionable activity is taking place on a higher level

And their customer service is stellar, I guess that is if your e mails don't get "undeliverable errors"

An OEM would not bother me as long as they honor their rebate.

All The FTC and/or State Attorney General would have to do to establish reasonable cause is to review the thread and see that this is not an isolated incident, but widespread.

I already got my WD 80GB from outpost... it was a retail... and it was new. I sent in the rebate on Monday and my AMEX Blue PM was already authorized. No problems so far assuming the rebate comes. Total cost $42 shipped!

Interesting, coincidentally I just got a order cancellation notice from Outpost today.
It was from so long ago, I had forgotten I ordered the stuff.

From Outpost: "Please note that the item(s) listed below have been removed from
your order per your request to Customer Service or because the
item is no longer available from the manufacturer."

I can't tell if you are being sarcastic... but I didn't mean to throw it in your face. I just wanted to point out that quite a few of us had no (or only minor) problems. Right in the beginning when a couple people received refurbs, my order was put on hold but when it was fufilled a few days later it came through fine. It sucks that it takes so much time but I'm pretty confident if you go high enough up at Outpost the should be able to resolve your problem so you get the same deal I did (assuming you bought it with an AMEX). Good Luck.

I got in on this deal with AMEX pm. Anyhow, the HDD was backordered and took awhile to get here (but still within time to claim rebate - $75). Anyhow, I got a retail unit and sent the rebate off a few days back. I don't see what the problem is, though many have stated they received OEM drives instead of retail versions. It is obviously a mistake... but if you've done all you have and will, then that sucks. Sorry.
