Question - Has an actual Police Officer on the forums here listened to the recording, and may be willing to offer an opinion on what is and is not "proper" procedure?

Because, like I said - I see a guy (within his rights) giving the police an unnecesarily hard time, and getting similar treatment in return.

If you see him as being within his rights, shouldn't it be the police that were the ones giving the citizen a hard time?

I agree and also feel the situation was set up. I mentioned that earlier as part of an example.

Considering this guy was so ready to record this and was so obviously being an impolite dick, I wouldn't be surprised if he made the complaint against himself just so he could set up this situation.

If he had been harassed for free speech you'd be crying your eyes out.

I agree with this statement ( /shocked )

You have a right to carry. The police have the right to check on you.

These guys were being assholes to the cops.

They have the right to be an asshole to the cop.
In certain states you also have the legal authority to resist unlawful detention and arrest by a police officer.

If one of those rights is carrying a deadly weapon in public that panics another citizen then absolutely they can.

Also if one of those rights is something that not everyone has the right to do then they absolutely should check you are not committing a crime.

Are you being deliberately stupid? You can't see the difference between carrying a deadly weapon and voting. How one might be a crime and the other isn't.

You are the one that continually proves their stupidity.
Owning a firearm is a Constitutional Right. You know, those things we got after we kicked your limey asses out.
Carrying a firearm is not prohibited in areas and thus shouldn't cause concern amongst people, but the bleeding heart cry baby liberals are so scared of inanimate objects that they piss their pants and call the cops and waste their time on such things as a guy with an umbrella with a sword handle in a mall yet report a man with a gun.
If more people carried, it wouldn't be an issue because anything that came up, people could handle it.
The police sure didn't help anyone at VT or Columbine or UT, or Lubys, or any of the other mass shootings, because the police respond to crime, they don't prevent it.
I having been the victim of someone trying to rob me at an ATM have prevented crime by sticking my gun in someones face and watching him high tail it out of there. He's going to seriously rethink his chosen profession.

Funny that when screenings for eligibility for a right can be limited to brown people through racial profiling, conservatives are all for them; yet when a cop stops a white person, suddenly he's untouchable.

The Maine constitution limits the right to citizens, so if he's not a citizen, he has no right to open carry. We don't want dirty illegals stealin' our rights, do we?
By the conservative model, if equally applied, he's deportation fodder.

But, of course, we all know that conservative models are nothing but bullshit rationalizations smokescreening capriciousness. They believe in a government of the whites, by the whites, and for the whites; and as long as whites hold the majority power they can get away with legislating imbalance -- "equal protection under the law" being meaningless in the face of, "gimme, gimme, gimme."

Conservatives are so retarded. They want absolute freedom for themselves, absolute restriction for "outsiders," and expect that the universe will comply with their wishes and magically fart out a mechanism of governing that can encompass both with absolute precision.
Complete and utter disassociation from reality.

Snipped for stupidity

Back under you rock pony boy. Only a true partisan shitbag turns something like this into a race issue.

Your infatuation with little girls cartoon is reason to believe you may be a child molester, the police should search and detain you.

IF owning a gun is a constitutional right as some say. Why can that "right" be taken away from you?

The same reason that your freedom of speech can be taken away, and you home can be broken into by SWAT and you shot, people are complacent, and continue to allow it to happen.

I just can't imagine a situation where someone openly wears a firearm on them and isn't some sort of jackass. It's just bizarre behavior like carrying a machete around with you everywhere you go. Do they go to work or shop with them? (I doubt most employers or stores would allow guns on their premises.) So really the point becomes to walk around the sidewalk looking like a tool.

(I'm not talking about the legality of it just the practical aspects.)

So, you think former felons should be allowed to own & bear firearms?

Mentally disturbed people?

Children?

They are all equal and citizens under the constitution.

Actually children are not.
But when the shit hits the fan, I am really not gonna sweat the difference between 17 and 18.
Theres no magic point where a child suddenly becomes mature. Thats why you raise them properly and you have fewer problems in society, especially with dangerous things like firearms and automobiles and marriage.

I believe that if you commit a crime, and serve your sentence you have paid your debt to society, don't you?

Mentally disturbed people?

My son has a 10/22, he understands, and respects firearms. It's not a tough concept to grasp.

I think more people should open carry. It's a nice red flag to civilized people that that you're a backwards redneck sociopath and that we should avoid you. Seriously, what kind of weirdo walks around with a gun showing?

LOL, you know you're redneck when you open carry. Of course the problem with being a redneck is you really don't give a shit what other people think.

Not at all - the Police have a duty to thoroughly investigate the complaint they received regarding a firearm.

The fact that the target of the complaint didn't actually do anything wrong is unfortunate, but not the fault of the investigating officers. As stated earlier, he would have been released faster had he not been such a Jackass about it.

THE POLICE WERE INVESTIGATING A COMPLAINT

Hint: If your neighbors call in a complaint to the cops about your stereo. A device which is perfectly legal, incidentally. The police are damned well going to go to your house and talk to you about it. AREN'T THEY?

So you're saying that they were wearing their guns too loud? :D

No more duty than they do for anything else, firearms are not illegal.

Investigating a complaint about a man with a firearm *IS* their duty. Talking to him is a perfectly logical extension of that duty. It's true the Open Carrier didn't "do" anything wrong. But neither did the Police. As far as the length of the stop, the guy was being a prick about it, and as far as I'm concerned he fully deserved the questioning he received. At 12 minutes, I have had traffic tickets take more time. This is hardly "Harassment".

Female Officer: "We have citizens who are concerned about suspicious activity. We got a complaint, and we are investigating."

All the police were doing is trying to follow up on the complaint.

As far as evidence of setup: This guy was also carrying a voice recorder, a copy of the Maine Constitution, and copies of Maine Firearms laws. He said so himself on his own tape.

By the way: You do know that you need a Permit to carry a handgun in Texas? And that said permit must be presented to an Officer upon request? And that open Carry is NOT allowed in Texas?

or perhaps you were hoping we wouldn't notice the hypocrisy here..

No amount of rationalizing on your part is going to make the cops right.

What the fuck are you talking about? He isn't in Texas dumbass, perhaps you were hoping we wouldn't notice your stupidity here ...
