So basically, the automakers will have to roll millions of dollars back into the price of their cars to cover the cost of lawyers. Can we then sue California for lawsuit recoving costs?

Because it makes sense to remove that last .00000001 parts per million of something when "gross vialators" are creating perhaps a million times more emmissions. When they track down all those busted up cars and semi's that pour crap into the atmosphere, maybe then they can bother the automakers some more.

In a strange twist, your 69 Chevelle might be better against global warming than a new emissions-compliant car. This is because a modern catalytic converter requires a slighter richer A/F mixture for proper operation than ideal, and it converts what might otherwise be sun-blocking particulate matter into greenhouse gases CO2 and water vapor.
Catalytic converters are the ultimate "sweep the dirt under the rug" solution. They get rid of the smell and help reduce the smog caused by particulates, so people think the problem's gone even though CO2 and water vapor levels are increased.

I'd have to ask if this guy jumped into his car after filing this suit. Sounds like he should sue himself as well for contributing to the problem.

there would just be new points of entry created. It's not like we wouldn't have a coast line anymore. :)

cars produce roughly 20-30% of air pollution. So that leaves 70-80% from other sources, the biggest is livestock farming. Next up is heavy industry followed by the Chemical industry.

So why isn't California suing them?

That Lawsuit is certainly ridiculous on one hand, but on the other it does draw attention to a harm that is usually ignored. I suspect the attention to the issue is the real motivation behind the lawsuit, if it isn't that politician is an idiot.

If you've seen the "electric car" movie you'll see that this lawsuit is completely and utterly bullshit.
