Ok, I have had enough

As some of you folks may remember, last January I was the victim of a rear ender on the interstate at better than 65+ MPH. I was doing 65 (the speed limit) and the guy who hit me nailed me from behind at better than 90+ MPH. He spun me from one side of the interstate to the other. I lost two weeks of work racked up 7K in medical bills, and have been diagnosed with a herniated disc and partially seperated shoulder.

The total in lost wages and meds is about 9K, and the insurance comapany only wants to offer 10K as compensation. Screw them. It is time for me to lawyer up and nail them to the wall. The guy has 100K policy limit, therefore I am going for the full amount. I know I won't get it, but I am going to make them pay out as much as possible.

Yeah, a herniated disk will require future surgery and treatment resulting in lost wages and future medical bills. there is such a thing such as pain and suffering. This guy who hit me was negligent, and had reckless disregard for the laws and safty of other people. He also hit 2 other cars and the back end of a semi truck. I just happened to be the first of many victims.

Plus, I am still out a vehicle, I still have pain and tingling down my arms, I still have to take pain meds because of the herniated disk.

Thing is, they are saying it is a soft tissue injurty, and the dr says it is a disk injury. so they want to cut me off from medical treatment, even hough the dr says I could be in treatment for quite a while, including steroid injections into the spine.

A lawyer is your best bet.
Hit the insurance companies, and then sue him personally.

Dude, it's their job to keep bring in as much money as possible and pay out as little as possible.

Bring in a lawyer and see what he can do to assure that your future medical bills and lost wages will be paid. What you will probably need is a doctor to come in and to give his expert opinion on how much in future hospital bills you will receive, and how long you will be out of work because of them.

But don't get too greedy, that always comes back to bite you in the ass.

Definitely look into an experienced personal injury attorney. Insurance companies are the devil.

I already offered to settle this with them for 20K and I would go away, buh bye see ya later. but they won't come off of 10K no matter what. So they pissed me off, and I am getting a lawyer. And no, it is not one of these ambulance chasers who you see on tv. I called the bar asso. and got a refferal, he also has done some work for my father. so this one is going to do me right.

Pain and suffering? Herniated discs are baaad. The moron who hit him should be forced to pay as much as possible.

if you win and the guy is good, give him something extra. a good lawyer is invaluble when you need them and a little something now for that extra mile later is well worth it?

Many times insurance companies will either deny claims or offer partial payouts because they can get away with it. Most people will not get lawyers.

Nail them for lowballing you right off the bat... they're not even trying to take care of the situation.

My mother spent the better part of a month unable to walk due to a herniated disc. Best of luck to you with that. Don't be greedy. Get what you deserve, not what they deserve.

You had an accident of that magnitude and never consulted a PIA? In NYC people call their lawyers before the ambulance arrives. That is an open/shut case there from the start.
