Did you read the article? He was on a motorcycle. And grabbing the girl would have only elevated an already tense situation. How would she have reacted if he had simply grabbed her? More than likely, she would have fought back and he would have ended up using force in order to restrain her.

umm...that's alot more physical than macing someone genius. And should he have thrown her in the back seat of his motorcycle? Oh, and was he macing her for jaywalking? NO. He was macing her for ignoring him and not following orders.

now a days with young kids you can't be to careful. she could have been armed. maybe this experience will calm her apparent bad attitude.
Where in that article did it state the cop 'got off' on macing a little girl? Nowhere. He stated:
After the last warning and order, it became apparent that I had to choose between a physical fight and using the pepper spray," Roberto wrote. "I sprayed her in the face."
And
The deputy repeatedly warned her that he would use pepper spray if she didn't listen.

I have a 15 year-old daughter, myself, and had she exhibited behaviour like that, I would not be suing the officer. I'd be taking a long, hard look at how I raised, or rather, didn't raise my daughter.
Thankfully, I and her mother have done a fine job and she's an amazing person.
so the morons here that think the kid shouldn't have been pepper sprayed believe that after the girl ignored the cop SEVERAL times while she was jaywalking, the cop should have let her go? the cop used a last resort. they are giving tickets to try to PREVENT kids from jaywalking in the first place to save their dumb asses from getting hit by cars; if it takes one kid to get pepper sprayed to save lives, more power to the cop.

You have to consider the costs of each possible outcome.
1) Do nothing. There already have been numerous accidents at this site as the link stated. Doing nothing will let accidents continue until one day there will be an accident involving the death of an innocent student. This will problably end in a lawsuit where the local government might pay hundreds of thousands or maybe millions. Even if the school wins, the city is out a lot of money for the lawyers.
2) Pay a couple of cops for several weeks of work every year or two forever. I don't know the specific details of this so the cost is difficult to estimate (a) are students coming and going all day long, or just at the beginning and end of school (b) are the cops getting overtime for this work - or are they just ignoring their normal duties, etc. This likely will be relatively ineffective in the long run - as jaywalking will still continue (but at a lesser extent) and could again lead to an accident with a lawsuit.
3) Build an walkway. This will solve the problem for good - but will likely cost $1-$2 million. Could be a decent solution, but won't likely be done due to the cost.
4) Build a fence blocking that part of the road, so that when students cross they will have to go around the fence and use the crosswalks across the highway. Very cheap, and very effective.
5) Other? These all depend on the circumstances of that particular place. Speed bumps in the road, to minimize accidents? An additional crosswalk with light? Etc.
