"Court Overturns Ala. Sex Toy Ruling


MONTGOMERY, Ala. (AP) - A federal appeals court overturned a ruling that had found Alabama's ban on the sale of sex toys unconstitutional and sent the case back the lower court to reconsider.

U.S. District Judge Lynwood Smith of Huntsville ruled last year that legislators had no legitimate interest in passing the law. The judge described the law as ``overly broad'' and said it violates due process rights because it bears no ``rational relation to a legitimate state interest.''

A three-judge panel of the 11th U.S. Circuit Court of Appeals on Friday disagreed with that ruling, saying the law ``is rationally related to the state's legitimate government interest in public morality.''

In sending the case back to Smith, the panel told the judge to consider whether the law might be unconstitutional for other reasons.

Their ruling said Smith had ``analyzed neither whether our nation has a deeply rooted history of state interference, or state non-interference, in the private sexual activity of married or unmarried heterosexual persons nor whether contemporary practice bolsters or undermines any such history.''

Attorney General Bill Pryor said Saturday that he was pleased with the ruling. ``Our duty is to defend the laws of Alabama,'' he said.

The statute deems selling or distributing ``any obscene material or any device designed or marketed as useful primarily for the stimulation of human genital organs'' to be a misdemeanor punishable by up to one year in jail and a $10,000 fine.

The law was challenged by six women who either sell sex aids or said they needed them for sexual gratification. The spokeswoman for the group, shop owner Sheri Williams, could not be reached for comment Saturday.

The law hasn't been enforced, pending completion of the legal challenge."

Actually, this Alabama thing hits close to home for me. I'll spare you the details, but this is one of the issues Mr Isla and I had to deal with. It was quite battle. And yes, he comes from a family with roots in Alabama, conservative born agains, etc.

Interestingly enough, a good friend sent me this link today. Since it is in the spirit of this thread, I'm posting it for all the disgruntled women in Alabama!

Haha :) No, it just always annoys me when people are not truthful and others believe them. Agree or disagree with the real ruling not some trash site from a radio host.

Point STILL stands though - why the heck should the sale of sex toys/aids to adults be regulated!?!? The fact that it's even being considered is an affront to the right of citizens to at least a tiny modicum of privacy in their own darn personal choices.

Maybe cause people don't want to live next to a sex toy shop, just a thought. Whether the government should regulate this or not is a whole different issue. But I think this ruling has less to do with regulating peoples private lives and more with how the state regulates what businesses can sell. From my understanding a woman could still go buy her "toys" somewhere else (out of state).

In MY state, I'm not sure if you can be arrested for wanking, but you CAN be arrested for getting wood in public. That's right. GETTING WOOD. Not SHOWING IT. --Not EXPOSING IT. The mere act of GETTING AROUSED in public can land you in a whole HEAP o' trouble.

There are many stupid and old laws that don't apply today, and hence are no longer enforced. Just because a law exists doesn't mean that it will be actively enforced.

Au contraire, dear redneck. The law I speak of that makes it illegal to sport wood in public was passed LAST YEAR. It is a NEW LAW.
