Didn't Valve add a line to its Terms of Service a couple years ago stating that you can't take them to court and that all grievances must be solved via arbitration? I recall some sort of hullabaloo over it....

There are precedents that would essentially invalidate that. You can't sign your rights away. You have the right to take someone to court and let the judge mull over the fine print and your grievance with them.

The thing is, they are required to.. but it's not like you can call the cops to force them to. Only recourse is to take them to court. You'll win, but it's a massive pain in the ass to do it. Not to mention you have to shell out a lot more initially to make it all back and usually a little bit extra because most violations of this sort include a punitive aspect to the restitution of the consumer. I'm speaking from experience here 🙂

Over $60 not worth it, but if they won't it is certainly worth it to complain to wherever you can. You can try the BBB, but Valve already has an F rating through them and doesn't look like they care about it.

At least if you wanted to go to court you could do so with small claims. Chances are you will be awarded de facto when they fail to show up. As far as getting Valve to still pay up after that would be a pain though.

No, not taking them to court. But I can file a few complaints with agencies and authorities (pretty much already done). I can cost them a lot more than $60 in future business, however. And all I would've even been happy with is store credit. It's poor customer service and, as I mentioned before, it's not the first time they've shown me they don't care for me as their customer. I'm not turning a blind eye to it this time, especially when their competitors have shown it is possible to do the right thing.

Yea in this case, they lied. They deserve what they get. They could have easily nay say'd any information that was incorrect, but they didn't. They knew what they were doing, and probably because of the whole 'oh it's a game' mentality. The time has come for companies, people, to be held accountable. I don't care if they go under and never want to create another game.

This is quite unfortunate, but they won't get any more of my money. The only hard part with that is getting content for my Vive, but I think HTC runs their own store now too or will be soon.
That sucks. I'm waiting for my rejection letter too I guess. It really is sad because I have two games in my cart that I want to purchase but I refuse to do so.

Really sucks that I bought a Vive but hopefully HTC opens a store like you mentioned earlier so I can avoid Steam like the plague.

I feel like I've gotten my money's worth. I'm 25 hours in and still enjoying it. I've certainly gotten worse value for my money in the gaming world.

Saying a car has "dynamic sports like handling" is a puffery statement. As that is not an objective based statement. Saying a car out performs the average formula 1 racer on a track is something else. That is a specific claim and to make such a claim means the maker of that product better be able to back it up.

With NMS we have specific claims as to what the game was suppose to incorporate. Those claims are something can be realized, tested, and observed objectively. They aren't there. That's called false advertising.
 
You could have just said the car is claimed to have a steering wheel but when it's released no steering wheel included- false advertising. That's No Man's Sky in a nutshell.
 
Or a vehicle that claims to have 6 airbags, but when you buy it and get into an accident you find out the hard way.

I used that link you referred me to which was the ticket system. I played 5 hours, but when I was building my new rig they somehow mysteriously added 1 more hour of game play when I had no PC to play this game on, but whatever. I submitted a billing request ticket in hopes that a live human being would get it and route it to the most appropriate location.

I'm just really surprised they refunded me. After all of the denials i've seen from everyone I just assumed i'd be denied as well.

Oh well, they did me right so now i'll go ahead and continue doing business with them and NEVER EVER pre-ordering anything again. Lesson Learned.

I've only ever pre-ordered one game and it was Battlefield: Bad Company 2, good thing it was worth every penny. I did also attempt to pre-order NHL 15 for PS4 but then an insider (someone from GameChanger I think) listed the missing features of the game so I cancelled my pre-order and that's that. Who cares if I miss out on pre-order bonuses, that's the gimmick being used to pull in guaranteed money for game companies. My next purchase will be Forza Horizon 3 and perhaps PES 2017 but will wait until after release for user reviews.

Here in Vancouver, there is a housing crisis and in the lower mainland there are new apartments and townhouses being built, there's a new townhouse complex in the process soon but hasn't even broken ground yet. People were lined up the sidewalk to drop $20,000 to reserve on the moment the unit sale opened and no one has any idea of the home design and only recently found out that they're barely 400 sq ft. And you can't get that $20,000 back, it's absolutely sickening that these people are dropping money on a home without any idea what it'll look like or how big it is.

Congrats! It really does seem like YMMV depending on what customer service rep you get handling your tickets. I also learned not to pre-order but from two earlier games. The Halo MCC and also Mech Warrior Online. I have plenty to keep me occupied without needing to jump into a hyped game Day 1 like in this case, NMS. Also, with online streams like twitch, I get a good preview of what I thought I want to play first which is great.

Dam that sucks. To drop 20 large on living quarters only to find out that it's the size of a shoe box.

The negative review I wrote didn't hurt so give it a shot. I read on Reddit to keep two tickets open. The automated one and the Steam support one.

They denied my automated refund ticket and a few days later I got the refund from steam support.

I say this, don't take it personally, be detailed and firm in your request for a refund (don't be rude), and keep trying. Someone did this up to 10 times and finally got a refund.

Thanks. Great words of advice. Had I not been following this game and all of the promised potential I wouldn't have even considered a preorder. But like you said we have twitch now and waiting for reviews a few days after release won't kill ya.

I really wished that HG would have came out with a $20 EA game and slowly added the features.

pretty sure they did after a lawsuit in germany iirc

sony did the same thing iirc
 
In the case of Steam, you've already agreed to the EULA before you buy a game so it has a good chance of holding in court. The cases they didn't hold were the ones where the user had to agree to one after already buying the product. Ex: Buying a computer from a store and then being forced to accept Microsoft EULA to use it once you get home.
 
yes, i get that. that's not what i'm saying.

look at it from the perspective of the developer. the game is in development, and the internet generates a massive hype. you KNOW you gonna make money, what do you do, start to downplay it, say that some features will probably never make it into the game? or do you ride the wave?

you need hype to sell. every product is hyped to some extent, some more and some less; you can't advertise a product as being "meh" and expect people to buy into it. they did what every other developer, or rather, what every other business does, and they just happened to be more successful than others, because *randomness of the internet* , because *spaceships are cool*, because *survival!*, so they did what every good company does when they are in this situation - they lied.

Come on, they are Hello Games, not EA, not Sony, not (other famous developer) but a small bunch of new developers who were already spending their earnings before the game was released, because they could not believe their luck as to what awesome results they got from the hype-o-matic 3000.

If you want to blame someone for the excessive hype, blame all the bloggers, youtube videos, videogame magazines, who make a living out of hyping every possible chunk of ... that comes across their desks and doesn't look the same way it smells.

I'm almost sorry for the guy, i might have lied too if i found myself in the same position; it's not easy when you feel that everyone has these great expectation off of you, to say "i'm not the guy";

And Steam is refunding everyone, so who cares. But really, making all this fuss about a developer who lied .. what about mass effect 3's endings? what about stalker, all three of them, being unplayable through crashes and save corruption? what about the tons of indie games who are completely broken ? what about the people who paid $20 for a Pay to Play, only to have it go F2P the next day? Man, the list goes on, with game over game over game of broken features, terrible optimization, incompetent coding, bugs, glitches, exploits, crashes, server overload, Battlefield's horrible netcode, Assassin's Creed's people falling through the geometry, Sony server crash, Batman's framerates, RAGE's textures, DUKE NUKEM!!

Denied twice, so far. I never did an automated request for a refund though. Haven't had the game installed for a week.

I'm going to keep trying. Eventually, they are bound to get tired of me, lol.
