NGOHQ claiming anandtech ripped off their newstory about NVIDIA?s 7800GTX 512 meg video card

Yeah, but it didn't occur to "anyone" to disassemble a device driver to glean insights into future NVIDA product releases.

Whatever, i and many other people have been doing this for ages. Guru3d shows you it almost everytime you look at a Beta driver. This isn't new.

So this was all just a PR ploy. He didn't contact a lawyer, he knew nothing was stolen, he knew they didn't have a case, he knew that NONE of the comments in those forums were against TOS.

I for one hope this never appears on a court docket, as this would truly be a frivolous lawsuit regardless of which party pursued it.

As to their claim of plagiarism, it certainly doesn't appear to be so from this layman's perspective, they did however present the information about the 7800GS first, on Oct 22nd. KK, you said parallel discoveries often happen in the industry, but 7-8 days is not parallel. Obviously it couldn't have been that AT was unaware of the article since it is linked, albeit without even giving them the benefit of naming them.

IMO, it would have been a magnanimous gesture to have given a more direct credit to NGO, a very small site, instead of the offhanded method employed. Simply because they are small doesn't mean they should be treated arrogantly, which is how the comment "Unfortunately this will be their highest traffic day all year!" read to me. Perhaps if they had been given the named credit for a contribution that other sites recieve, that would have been their biggest trafffic day all year? :light:

Of course, they have responded in a manner that has sabotaged any hopes they held of growing into a respectable "peer" site, and that is the truly unfortunate thing for NGO IMHO. I can't agree that NGOHQ deserved a magnanimous gesture because they came out immediately swinging the plagiarism stick.

They also posted KK's initial email response on their website without his permission & ridiculed it. After that the twits only deserved to be ignored.

I've seen that sort of thing way back - nothing new at all. All it is just a little bit of reverse/lateral thinking. In short you can claim right over a procedure like that over publically available drivers even if you were the first to do it (which NGO weren't just for clarity). Some credit would be nice of course, but that's just 'moral' - so it's not even ethics and certainly not even law.

They handled things about as badly as you could, but presuming the e-mails they posted were not altered, it appears they pointed out that the article was replicating their's, and asked rather bluntly and tactlessly that they be given credit for it. KK's response struck me as paraphrasing for, {you are a insignificant little site I never heard of, and I don't plan to acknowledge that we were scooped by you in any way} Power corrupts

Why not add to the article that NGO's article managed to slip under the radar, and that having had it pointed out, AT would like to acknowledge that they provided very similar data about the 7800GS a full week before? Instead they added a link that didn't even boast the site's name, and failed to address the fact that the same method for uncovering the data was used. Given how KK acquired the info, it is entirely possible, if not probable, that the info was gleaned from the NGO article and he recieved it 2nd/3rd/ect hand.

Again, none of that excuses their very juvenile and unprofessional behavior towards AT or those who joined their forums, but IMO AT picked up some bad karma on this one.

They dont appear to be but the articles are. They merely highlighted in red a few random things. If you bring up a window of the AT article and a window of the NGO article, you can see that there is virtually nothing similar, except the way in which it was done...remember there are only so many ways to sift through the contents of a .dll,

Unfortunately giving them much attention also gives them credibility. My publisher advised me not even to put the link up in the first place - but I already did that by the time he told me that. I didn't think it was such a big deal since we have emails from this stuff dating back to the beginning of Oct, with third parties CC'ed too. The guy really had no chance if he wanted to make things legal.

EDIT: BTW, I don't think they could prove anything unless it happened to be the same article word for word. Even then it would be tough to prove it was stolen from them. This is the internet people, the police don't exist on here.
