And sometimes it doesnt even matter if it does cause system instability *cough* Cat 3.4 + any HL based game *cough*.

I think it is just a nice fee Microsoft charges vendors so they can say they have WHQL drivers.

It's up to the game developers and graphics card company to handle compatability with third-party software like games. MS just makes sure it won't crash Windows.
