Like so many above me stated, you could use a camcorder to show the speed. Personally I think a better use of your camcorder (if you have one) would be this. From now on if either the neighbor accussing you or the cops come back by ask them to wait before they start the conversation. Go into the other room and get your camcorder. Come out with it recording. Record every conversation. If the neighbor comes back barking and yelling, you'll have proof he's an unreasonable, irate, grumpy old man. With the cops, just tell them you want proof of harassment. See if the cop is rude at that point. If he is, then you have proof for filing charges agains the officer. You just have to be sure to get the badge number and name in the video.

i totally agree with this. having it on the record will help you out if things complicate later.

also, if these are small kids and they are playing in the street, then by all means call social services. better that guy gets in trouble then one of the kids getting run over.

this is up to you. dunno about kids getting run over (I'm guessing you and your fiance are safe drivers), but do call social services, just to light a fire under your neighbor's ass.

I think this sounds like a really good plan too. I don't know how the police would take being on camera. I think they would have a problem with a camcorder. I really think it's a good idea to record the neighbor guy though. I really want to catch his reaction.

how about fixing a camcorder to a tripod so it always points to the door. turn it on before you open the door, regardless of who it is. if the cop asks you whatup with the camera, tell him you're being harrassed by your neighbor and felt the need to videotape everything for your own safety.

Man that suxs,

I like the switching car idea, that might help. As far as the camcorder goes you would need to do it every day. A good way to show time/date is to have the daily newspaper recorded before you get to his house. Child services isn't really that great of an idea but it may come down to it. I know I played in the streets as a kid, by in my day that was just the way it was. And I would record every conversation as mentioned, even the ones with the Po Po.

Also, get a bat and keep it by the door just in case. If he comes over have him walk to the sidewalk where you can continue the conversation. If he refuses to leave let him know that you will forcibly remove him from your property.

The only problem with this would be our neighbor kids would either break it or steal it. For unknown reasons they like to cause problems with us also. They throw bricks in our yard and leave their toys all over our front and back yards. They even throw toys from their happy meals over the fence into our back yard. I have talked to them before when their daughter came over and peed on our porch. The guy that is harassing us is down the street farther (for clarification purposes.)

I know you dont want confrontation, but that is really what it is going to have to come down to. He has no right to basicly tell your fiance to not drive down his street, And if you let it slip by now it will only get worse, Sure she may slow down, but then their will be something else, Maybe she didnt signal before turning on the streat or something to that extent and it will just keep going. Documentation and a law suit will probibly be the only way to stop the cycle and get on with a regular life.

yeah my neighbors are not the nicest people I have ever met. They have hated me from the day I moved in because I was only 19 when I bought my house. The people on the other side of me are the nicest people and we buy each other xmas gifts. They always chat with us when we're outside. I know that we're both really nice people and don't want any trouble from anybody. All we want to do is live our lives and not feel violated by having the neighbors come over and cause problems with us and then call the cops on us for no reason at all.

*NOTE* This has nothing to do with the situation at hand it's just background info in response to Fausto

That's the solution! Rent Fausto's crackhead neighbor to camp out in your front yard for a while!

Have him interact with your neighbors as much as possible.

The cops really can't do anything about the camcorder, I believe. You're not hiding the camera, you're just recording the conversation for future reference if your neighbor doesn't back off. You can say you want all incidents recorded and since the cop is involved you want to have it a proof in case you need it. Someone else might know for sure on the 'recording a cop.'

hahah I'd be half tempted to try that idea but then I'd have a freeloader I couldn't get rid of. Maybe he could get them to move away :)

Just tell the cop to get the fvck off your property next time he enters it. And report the asshole neighbor to child welfare services for letting the kids play on the road.

somehow I think telling the cop that would just cause even more of a problem. I'm willing to work to resolve this thing but the neighbor is just being unreasonable and the cop is taking his side. The cop I'm speaking of is a small town cop kind of like Barney Fife from the Andy Griffith Show. They actually tease him by asking about his one bullet. I know a few people that work for the city and they say that this guy over reacts to everything. He has came to my house before for my help in catching a lost dog that was running around my backyard after his owner filed a claim that he was missing.

Go over his head next time and speak to his supervisor. There is no reason in hell you should have to put up with this BS if you're telling us everything as it's happened.

If nothing happens their you contact the chief of police or the guy above that cop and file a complaint about the situation.

The only way to get his observation into evidence is under Present Sense Impression exception to the hearsay. Even with that, the trier of fact must decide whether or not the believe them.

You can discredit the witnesses in civl matters by prior false act (i.e. lying), I think.

you could place it inside the house, pointing towards the door at an angle. actually, given your sh!tty neighbors, you should look into installing a security camera at your front door. the way things are going, if it comes to a police case/lawsuit, everyone will think about your neighbors's kids and BAM! you'll be treated as guilty until proven innocent.

Please note that just because you drive a speed below the speed limit does not mean you are not driving recklessly (you can still be in the wrong).

If you know there are kids out, you have to go a speed that allows you to respond in time to prevent an accident. Why not just drive really slow by that house, smile and wave, show that you understand his concerns, etc.

I was bitched at for driving too fast in a clients neighborhood by some crazy guy driving the other way, I wasn't going that fast (below the limit) but I could go slower. When I go back there I go extra slow just out of respect for their neighborhood. Why wouldn't you do the same for your own 'hood? It's not going to take much longer to get him, maybe 30s-1minute and you won't have to deal with crazy neighbors.

Please note, I think that parents who leave their children unsupervised by the road are the real problem here, but, if you hit one of those kids it's not going to make you feel any better knowing the Parents are too blame. So, drive slower and do as others said, record the kids unsupervised and notify child welfare if they are in a dangerous situation. In the meantime slow down and don't worry about the cops/neighbor, if you are going that slow there's nothing they can do anyway.

The next time he comes over and yells at you just call the police and say some guy is tespassing and threatening you. Don't say anything else. If he gets real loud get it on video, he could be charged with low level assault. Also, if he lets his kids play in the street he's guilty of endangerment. Tell him you're calling child welfare.

The reason this is causing such a problem is the way the guy is handling it. He came over yelling. He wasn't willing to chat and just tell her about his concern he was angry and taking all of the frustration out on her for no reason. She was not endangering his kids in any way. She purposely goes slow because there are so many kids in the neighborhood. No matter how slow she goes he thinks it's too fast. If he was being rational and would actually talk instead of yell then I would have no problem at all. What he wants is totally unreasonable and he is acting like he owns the entire street I live on. If he was so concerned with his kids being out maybe he should keep them away from the road and in the back yard where there is no cars or at least keep them closer to his house and away from the street.
