How would you pursue the lawsuit? The owner said that his "home owner's insurance" would cover for the hosipital bill.

Well that's good that the home owner's insurance would cover the hospital bill (but i doubt it), but you can certainly sue for negligence. That dog should have been locked up if it's that aggressive and violent. We have dogs that wander the neighborhoods, but they're very kind. It's such a strange concept to have your dog wander, that at first my parents use to think they were lost, and would feed them (they kept wandering into the store to - my parents own a little asian food store). One kept coming back, so my parents put him in the back with our dog... then later that day, the owner of the dog comes to their store to buy smokes, and sees his dog tied up in the back! It was hilarious.

Wandering dogs tend to be more docile and less territorial than restrained dogs. Anyone who lives "in the sticks" is used to owning/interacting with free-roaming mutts.

Homeowners insurance will cover it, or at least it should. I know that it is in our renter's insurance agreement. They specifically asked if we had a dog when we applied for the insurance, and explained the reason for asking.

Yup. I testified for a woman in the area whose dog was mauled by our idiot neighbor's rott mix. She was walking her dog (on a leash) in front of our house and the neighbor's dog (not leashed) came charging across the street and tore her dog up. Owner of the rott initially said he'd pay the vet bills, then backed off that claim and got a lawyer. She sued in small claims, my wife and I testified (we both saw the whole thing) and he lost. If a leash law exists where you live, the owner of the dog that attacked yours is pretty much screwed.

My dog is a small, very peaceful Cocker Spaniell. My family has had him for 12 years and he is like a little brother to me in spirit. Dogs are truly man's best friend. The dog that bit him was definitely a bigger mix breed, I don't know the exact breed, just that its white with brown spots. I thought initially that this bigger dog came out to bark at my dog but then it turned violent.

I was wondering why someone made a remark about how dumb it is to walk your pets. I think that not only does it give your pet some exercise, you will also benefit. I walk a two mile block lap everyday and I just started since I took the Cocker Spaniel back from my mother. I always clean up after my dog ((wear garden gloves and carry shopping bags ((anyone have a better solution??)) and try my best to be a good citizen and neighbor. This small activity my dog gets from the walk helps him digest better, his weight under control, and he will hopefully live longer.

"Coco" is fine today. Besides just biting himself because of itches and wearing one of those dumb lampshades (doctor says it's a good three-four days before I can bathe him), he seems to be in good health and not limping anymore now that the bandage is off. I will pay the neighbor a visit with the bill and hope the financial side taken care of. I don't intend to use the court systems unless the neighbor is really stupid. I just wanted to share the experience to get some stress off and caution people about pet issues.

She was crying her eyes out, and after going off on my dog, I tried my best to console her. I offered to bury her dog, which in the end she declined, and then I left for work, which was where I was getting ready to go when this happened. I figured I would kill two birds with one stone and walk the dog while going out to warm up my car. I wish I had left the dog inside. That was a very greusome sight to behold, especially watching the dog trying to breath while coughing up blood. I guess its whole throat was crushed, windpipe and all. Very sad!

Bahhh! Just beat the crap out of him... That's what I would do..Though my dog was untouchable so I wouldn't need to do that... I missed my dog :(

yes, like that scene from fight club where he destroys something beautiful. idiot owners without leashes deserve nothing less. i've stood between my dog and loose dogs before.. not fun. i carry a knife but thats nothing i want to think about.

Some family friends of ours were having problems with bigger dogs attacking their smaller dog. They just bought some dog pepper spray to take with them on walks. They have only used it once and the other dogs owner was not too pleased but thats better then having a dead puppy.
