Normally I side for the little guys going up against the big guys, but this takes the cake.

Yeah, that's right, Nissan.com. No, not the car, the computer ...something. He's as guilty as charged, but not enough evidence to prove otherwise.

Nissan is his family name, so I guess he's selling his family on www.nissan.com. No really, why would anyone want to side with this convoluted arrogant dick-weed who squats on a trade marked name for his own personal purpose? Nissan makes affordable and safe cars while fueling the worlds economy with employment and goods. This guy is a self employed nut job who offers a generic service you can find walking 10 feet from your house. I don't think he has any plans on expanding to the size of Nissan Motor USA any time soon.

God that bugs me. I know some small business owners who deserve the world for the work they put in. Some of them make it big, but they earn their respect. Mr. Nissan hasn't earned anything but embarrassment. Nissan Motors however obviously earned their respect for many years.

I disagree with your assessment. Nissan motor is bullying an individual because he registered a domain before they did. boo fucking hoo, they have to be known as nissanusa.com instead of nissan.com. :roll:

I fail to see how he's anywhere near "guilty as charged". He OWNS the domain name, end of story. It doesn't matter why he bought it or what he bought it for, he legally has the right to do whatever he wants with the website (as long as it's within the ToS). Everything the OP has said is opinion, and last I checked, that means 0 in a court.

I don't see the the OP is all pissy about - this dude legally bought Nissan.com well before the Nissan automotive company died. Why should he be sued for owning it? That's absurd. If they want it fine, but they can purchase it.

The district court issued a final Judgment (PDF) allowing Nissan Computer to keep its nissan.com and nissan.net domain names, but restricted our rights to do the following:
1. Posting Commercial content at nissan.com and nissan.net;
2. Posting advertising or permitting advertising to be posted by third parties at
nissan.com and nissan.net;
3. Posting disparaging remarks or negative commentary regarding Nissan Motor
Co., Ltd. or Nissan North America, Inc. at nissan.com and nissan.net;
4. Placing, on nissan.com or nissan.net, links to other websites containing
commercial content, including advertising; and
5. Placing, on nissan.com or nissan.net, links to other websites containing
disparaging remarks or negative commentary regarding Nissan Motor Co., Ltd.
or Nissan North America.

What a crock of shit. Whoever approved that ruling needs to reread the first amendment. It did get appealed though... 2 years later.

I'm glad this guy didn't give up his domain name. OP should stop posting while retarded.

This guy is obviously not using it for commercial use.
That website took 10min to make, and he only put the computer business up after the initial conflicts with Nissan.

Nissan is probably losing millions of dollars a year by not having Nissan.com.

I hope the real Nissan wins this lawsuit and has to pay him $9.99 for his domain name.

Did you read the website at all? He used his family name for business purposes, that does not equal using it for his domain name for twenty years. Furthermore...

On May 14, 1991, "Nissan Computer Corp" was incorporated in the state of North Carolina. I was then, and still am, the company President. I have used Nissan as part of my trade name in connection with the sale of computer hardware, computer maintenance, networking, computer training and other consulting services related to computers. On June 4, 1994, I registered the domain name "nissan.com" and created a web site to promote computer related products and services on the Internet.

In July of 1995, I obtained a service mark registration for Nissan and my logo from the State of North Carolina.

if they concerned with losing that much money they can buy it from him. besides when someone goes to nissan.com and finds this dude, the next thing they do is google it and go to the right link. nissan isn't really losing too much money from this.

I don't think he should give up the name, but he's profiting off this too.

So he couldn't have had a business prior to the internet? Just because his business isn't as big as Nissan Motors doesn't mean he didn't have every right to the domain name.

He started the computer company YEARS before he got the web-site.

1. I wish Nissan had the domain name...simply because I've gone to the idiot's site before
2. It IS Nissan Motor's fault for not registering it first....despite what I wish, Mr. Nissan has every right to keep what he purchased....or sell it to Nissan for a huge profit.

Then I can shove a mouth full down your throat about law and human rights. (which I would be wrong in anyway because kitty porn would make starcraft look bad).
