Being an illegal alien, he doesn't have the rights of a citizen, certainly. But the rights we have in our country are based on the idea that ALL men (if you want to be technical about language) have certain inalienable rights. He may not be legally guarenteed rights, but as a human being, if we're true to our founding, he does have rights.


Historically, you're correct. But I respectfully disagree w/you in this case.

We are no longer in the "good old days of immigration" i.e. late 1800s/early 1900s. In this modern day and age, the legal immigration process is well known. And not to "go there" but every single immigration document this country produces is in English and Spanish.

Mr. Martinez knew damn well he was here illegally. That's why he didn't have a license.

It's too bad the boy is dead, but this is just another "illegal immigrant gets busted" story.

250 years doesn't negate the declaration of independence, constitution, and the bill of rights.. the guy still has the legal right to not be assaulted.

no, our laws do apply to him. if he murdered someone, he can and should be charged with murdering someone. similarly, if someone murdered him, that person can and should be charged with murder.

as for rights... he is implicitly given the right not be assaulted by sheer virtue of the fact that everybody in this country is bound by anti-assault laws.

According to the news last night, he swerved off the road and hit the kid on the grassy area. But, in today's Palm Beach Post article it says the kid was in the center of the road w/ family chatting w/ another driver on the side of the road.

Sun Sentinel says kid darted into road.

Who knows, doesn't change that both parties were wrong.

Perhaps if this bunch of people were watching the kid he would still be alive.

The vigilantes should be arrested for they beat him before they knew he had no license.

I'm not fully understanding this situation. How did the men who beat him catch him if he were fleeing the scene? Was he trying to stop, but they were jogging along side of him threatening him with a beatdown if he would just get out of the car? If that's the case, I would have stayed in the car most likely, and either gone to a police station or called from a cellphone. Granted, him not having a license puts him in the wrong, and the kid didn't need to be running in front of cars. Also, the guy didn't even belong in the country, so really, everyone involved is in the wrong, but beating the guy's head in isn't bringing the kid back, although, truth be told, i'd have done the same if he were my friends son. As for the givers of the beat-down being charged, who's to say anyone would come forward and finger them as suspects? That is likely the reason nobody has been charged. nobody wants to finger the vigilante who fought for the dead child. It's not really the polices' fault. Although there are many other things I can think of to fault cops with, this isn't one of them.

umm... the boy darted into the street? Granted the guy should have a liscense and shouldn't flee the scene but it can be hard to stop abruptly if a boy "darts" into the street.

Sounds to me like he was trying to get away and the crowd detained him until police arrived.

How did he get those bruises? Oh, he tripped and fell over... several times. :D

Something similar happened in my town too, except the kid wasn't killed, and the guy driving had a legal license and supposedly wasn't breaking any laws. Still got his ass beat, and had to flee and find a cop on patrol during 4th of July fireworks to get some help.
