Could have been faked. What they probably did was find a girl with the same height, hair style, body shape, iPhone, wrist band and checkered shirt. Go the the hotel in Madrid, Spain where Miley Cyrus was (probably blogged where she was staying or was followed) and take the "faked" naked pictures.

If there is positive proof that the picture is her, could she be charged with possession of child porn or some other thing?

The thought had occurred to me.
 
Interesting... I think the lines on just boobies are rather blurred. There's a movie called 'The Hole' where Keira Knightly flashes the camera, but she was 15 when it was filmed.

As far as I am aware there are different rules for "art" and "porn", wasn't there a 15 year old Australian chick who did a topless "artistic" shoot?

Or perhaps it's just that not everywhere is so keen to jump on the paedophile boat as America?
