What constitutes a poor design? Does this mean we can sue publishers for distributing games and other software that require patches to fix or repair flaws upon release? You can't sue over a bad xbox, you can sue over a poor design that does not work under standard conditions

The adequate response is to provide refunds to those who want one, and offer replacements or repairs to flawed systems as covered by the warranty.

The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses,
The lawyers get this portion
as well as the replacement or recall of Xbox 360 game consoles.
the consumer gets this portion
The warranty provides for the consumer getting their replacement portion without the lawyers getting anything...why don't we just take the lawyers out of equation. The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses, The lawyers get this portion, as well as the replacement or recall of Xbox 360 game consoles. the consumer gets this portion

Lets just allow corporations to ship shoddy products and call it a day
At $400 plus a pop it better work as advertised or they will be sued, and rightfully so. The whole power supply overheating was news on launch day, there isn't much dispute that there is a problem.

THERE IS A WARRANTY. If it doesn't work, GET IT REPLACED. Holy fvcking ******, there is a margin of error with every product released...
