DAMN! I had a 622 when it first came out. Sent it back TWICE as it constantly made coasters. They then sent me a 1622, still sucked. I think I actually sold it in the FS/FT forums a while a go. I wish I would have heard of this lawsuit earlier.

Funny thing...

Guess what I went out and bought today? A Memorex 40X CDRW. I was totally against the purchase until the guy at Staples said I could return it within 14 days if it sucked. Got it for $39.90.

I paid $299 for that damn 622.

I sent mine in june or so. Got rejection letter near end of july because I didn't have enough documentation. Sent in a couple days later. Received check in end of August.

well, I filled out a form stating that I have my cdrw drive, and that it doesn't work etc.. it was my understanding that they would contact me with information about where to send it to for replacement etc but I haven't heard anything from them and now the memtek settlement webpage appears to be down, does anyone have an email contact or can give me some info on this matter?

guys chill out if you havent gotten the stuff yet from the attorneys on how to mail in your drive etc. iirc the form stated they had until 10-15-2002 to send out the packages that we are supposed to use to ship our drives back to them (fully paid both ways by Memtek). of course i cannot verify this as the webpage is down.

refer to your copy of the claim (surely you made copies right??) to get the law office name, address, and perhaps phone number and give them a ring. iirc they have a webpage i was able to find on the net and a 1-800 number.

but BE NICE to them on the phone if you expect to get anywhere.

exisle, i am getting the same treatment. I sent in the claim form but I haven't heard of anything ever since. I emailed jshub@sheller.com twice before September 15th and never got an answer. Now the website is down. Can anyone post us a telephone number or address so we can follow up on the claim?

email addresses are composed of two parts: user name and domain. try that domain and see if you can find a number. i am fairly certain Mr. Shub is at their Philly office.

i'm not posting the info here because i don't want their office deluged with calls. you gotta do some work yourself. do you guys know NOTHING about finding information on the internet yourself??

They also rejected mine..... I called and spoke to a customer rep. The guy was pretty nice, but firm in the fact that the serial number was required.... :( I only had the manual, and he explained me that they need to verify the manufacturing date (sounds logical)

To the folks who got their check, what documents did you send as proof??? I am thinking that maybe a copy of a receipt could be the best bet, as they are dated. Obviously, a drive purchased before Dec 98 has to be manufactured before Dec 98..... ;)

The point now is how to get a receipt..... I was lucky enough to find the manual :|

I called them up and they had no record of me ever sending anything in. I use delivery confirmation and it shows that it was deliviered so that's odd. The woman on the phone said he should talk with the administrator of memorex and he would call me back in a few weeks. Basically, it just sounds like they were trying to get me off the phone.

It's unfortunate that no one posted the number here to contact people reguarding the class action lawsuit. Oh right don't want to flood them with calls. The thousands of anandtechers with 4 year old 2x cdrw drives.. yeah.. okay. The place was contracted out by memorex to help them process the settlement so flooded with calls or not it's their job to handle it.

Got my burner in today, but I haven't had a chance to install it yet. Not a bad trade for a slow burner that served me well but I haven't used in a couple of years at least. I sent the old one in about two weeks ago.

I sent my unit in 2-3 weeks ago. I don't know if they are gonna actually send me a replacement drive, I've got nothing to lose anyways.

OMG, you guys wouldn't believe this, they sent me a 40X 12X 48X cdrw today. It is brand new, yippy. I don't know why I am so happy since I paid 300 for my old one and it crapped out on me after 20 cds.

Well I was expecting a 2x-12x replacement. Oh well, this 40x only worth $50, that means they cheated me for about $200.

I contacted the lawyer in charge as I wanted to know how to handle (2) claims, as I had purchased (2) drives and wanted to make sure that both claims went through. Here is his response:

You should submit two proof of claim forms, one for each drive. For the drive you still have, you are entitled to receive a replacement unit. The claim form for this unit should reflect that you are requesting a replacement drive. For the second drive, which you no longer possess, you should submit a separate, second claim form requesting the $50 benefit.

In order to avoid any confusion regarding the submission of two claims for two separate drives (i.e., one claim seeking reimbursement and the other seeking the cash benefit), I suggest that you submit all of your materials to the claim administrator in one package and include a note with the package indicating that you are submitting two claims. This should prevent any confusion.

The replacement drive will be a Memorex 40x CDRW. Attached are pdf files containing a 40x product description and technical specifications.

Details on the Memorex 40x CDRW can be found at Memorex 40x CDRW. Some people have been buying this drive recently for around $40-50 after rebate so I think it is a fair replacement. People have been reporting that they are getting LiteOn drives which is a good thing, as some can be unlocked up to 48x.

Don't forget to mail your claims in soon if you have not already.

Hey guys,

I sent in a claim form early September and, like many of you, have yet to receive anything back from them.

Can everyone who sent in a form and never received any response please make a post stating that fact. I'd like to beable to call them up and let them know that they are going to have a lot of unhappy people on their hands if they simply state that they "never got it".

Also, anyone who ever emailed or talked to the attourney or anyone else involved in the case, can you please post what information you received from them.

It's crunch time on this for those who have not received anything as October 31st is just 2 days away.

Any post with any infromation would be appreciated on this matter.

I just received this from the law office in response to an email requesting the status of my claim.

Please call the claim administrator, Rosenthal & Co., to obtain a status report about your claim. They can be reached at (800) 207-0343 between 9am and 5pm PDT. As Rosenthal maintains the claim database, they are the best source of claim information, including claim benefit fulfillment dates.

just spoke with a person @ Rosenthal. she claims that they were SLAMMED with claim submissions -- Way more than they expected and as a result have been behind in processing claim forms etc.

they just mailed out another large batch of pre-paid mailing labels yesterday to those who still need to submit their drive, so don't expect to see anything for another few days. they realize the final date for submission of our drives is Oct 31 (tomorrow) and have extended the deadline as a result. i'm not sure what the new deadline is but i'm sure that will be included with the mailing label information.

give them a quick call if you have still not received your check or drive as you expected by now. they were able to immediately assist me over the phone to check on the status of my claim.

i think this will all be resolved eventually, and we will all get our money or drives, but it will take some extra time. hang in there...

last post for a while, i promise. :)

just got a call back from the person I spoke with @ Rosenthal. apparently in addition to sending out prepaid mailing labels yesterday, they also sent out "deficiency notifications" to people whose claims are essentially being denied. i am lucky enough to receive such a deficiency notice, despite my purchase date pre-dec 1998 etc. i am more than a little annoyed about this entire situation! :(

she said that there may be some way of resubmitting a claim that has been marked as deficient, but was unable to discuss the various issues on the phone and instead instructed me to wait for the letter.

i for one will not take this lying down, and will be demanding the $50 I am owed through whatever channels are available... now these lawyers have annoyed me. here is their complete details:

Another update...

I got my letter with pre-paid UPS shipping label to send my old burner in last week. I just shipped it off today... Says new drive should arrive in 3-4 weeks.
