Memorex / Memtek settlement -- new details 8-15-2002

Just got an email back from one of the lawyers who handled the class action lawsuit against Memorex / Memtek. For more details on the lawsuit including Claims Forms which must be reveived by Sept 15, 2002 -- see Memtek Lawsuit website for more details.

I contacted the lawyer in charge as I wanted to know how to handle (2) claims, as I had purchased (2) drives and wanted to make sure that both claims went through. Here is his response:

You should submit two proof of claim forms, one for each drive. For the drive you still have, you are entitled to receive a replacement unit. The claim form for this unit should reflect that you are requesting a replacement drive. For the second drive, which you no longer possess, you should submit a separate, second claim form requesting the $50 benefit.

In order to avoid any confusion regarding the submission of two claims for two separate drives (i.e., one claim seeking reimbursement and the other seeking the cash benefit), I suggest that you submit all of your materials to the claim administrator in one package and include a note with the package indicating that you are submitting two claims. This should prevent any confusion.

The replacement drive will be a Memorex 40x CDRW. Attached are pdf files containing a 40x product description and technical specifications.

Details on the Memorex 40x CDRW can be found at Memorex 40x CDRW. Some people have been buying this drive recently for around $40-50 after rebate so I think it is a fair replacement. People have been reporting that they are getting LiteOn drives which is a good thing, as some can be unlocked up to 48x.

Don't forget to mail your claims in soon if you have not already.

Wow! I bought one of these in early 98, and used the heck out of it, though it made a ton of coasters too!

Any idea when these burners will be shipped out? I sent my claim form in about 6 or 7 months ago and haven't heard anything. I assume it will be sometime after the claim deadline, but how long after?

Wow - I used to have one of these drives way back when but I threw it out after so many coasters and no reliable service. Its a shame I dont have any documentation saying that I did actually own one...but I did. Too bad. My fault for not hanging onto something that I would have no use for (manual or receipt).

Please note the following important dates:

Settlement Hearing ? June 7, 2002
o A Settlement Hearing was held on June 7, 2002, and the Court approved the settlement as fair, reasonable and adequate.

Fullfillment of Approved Claims ? Begins August 23, 2002
o Checks or detailed instructions for returning CD recorders will be sent to apporved claimants beginning August 23, 2002.

Deadline for Mailing Claim Form ? September 15, 2002
o You MUST complete the Proof of Claim Form and mail it to the Claims Administrator by September 15, 2002 to qualify for the benefits described in the Notice of Class Action Settlement.

Deadline for Returning Drives ? October 31, 2002
o The last day to return the drives for replacement is October 31, 2002. You will receive a replacement drive of equal or greater value, approximately 3-4 weeks after we receive the returned drive.

it is my understanding from reading the above that they will be mailing out instructions on returning your drive as of Aug 23, and then you have until Oct 31 to return your drive, at which point they will send you a replacement within 3-4 weeks.

Does anyone actually have their drive still?

I still have my 1622 drive, though it was in a 2nd/3rd system, and wasn't being used to speak of. It made too many coasters....and now I know why. :)

I still have my drive, although it hasn't ran in years (and I bent some of the ide pins). :)
I'm glad to see this thread come back since I forgot to send in my settlement paperwork.

Folks, this IS a Lite-On drive, and it does flash to 48x. Everything you need to know about how to do it is in this thread. Benchmarks show the Lite-On firmware does a better job of burning than the Memorex. I did this, and for even more good news, after I updated the copy of Nero 5.5 that came with my old Lite-On 24x (since last January), it recognized the new drive and works perfectly. :D

Of course, you won't be able to use the bundled Roxio Easy CD Creator.

I strongly recommend following the directions about backing up the original Memorex BIOS. As alway, if you screw it up when you flash it, it's your loss, but if you need to return it under warrantee for something NOT related to the flash (tray doesn't eject, etc.), you may want to flash it back to being a Memorex before you return it.
