ok, i just filled out forms to the FTC, BBB, and emailed my local fox newstation (they have a special section on scams and fraud) will the police do anything? i am emailing office depot right now.

Look, if you're not going to step up and bring the authorities into this, then you deserve to be out the $300.

The store contacting the police does nothing for you. The police will only investigate for them. You have to call the police and report the store, and in particular you need to get the manager's name on the report. The store has acted in a fraudulent manner, that is illegal. Especially contact their corporate offices. Give them the details, including the store number and the manager's name. If you don't have the manager's full name, go back to the store and ask him. If he asks why, tell him it is for your letter to corporate, the police report, and the State District Attorny's office. Don't be rude, or snide, and don't offer the information unless he asks. After you get your reply from corporate, if they do not replace the bag of sand with an iPAQ, then definitely contact the State Attorny General's office. There is nothing that says you need to afford a lawyer in this situation. Consumer protection is one of the things that the State DA is responsible for.

And if you don't do any of this, then you really do deserve to be out the $300.

DON'T EMAIL OFFICE DEPOT, call them, write them on paper but don't email them. Email is just a waste of time. Call the CEO's office by voice (it will be a toll call).

wouldn't the FTC be the authorities?

ok then i will tell the police about it soon. and i am looking for information to contact the State Attorny General's office.

how have OD acted in a fradulant matter? i might need that for the police report. they said that they have contact the police as well.

oh yeah, an i will write a letter the OD coporate like you said.

Don't use email for any contacts, it's too easy to click the 'delete' key. Write a nicely formatted paper letter. What I did for a rebate gone bad was explain the situation, photocopies of everything and sent a carbon copy to the FTC, the BB, AG and of course, the rebate company.

Joony, I do feel bad for you, but like I said in my previous post, you never should have left without a new ipaq after the first time you went back their. That only made them think they had you on the run. What you need to do now is get the authorities involved, and make sure that they know that their name is really going to get dragged through the mud, they really do not want that. Trust me, that manager could lose his job over something like that and if he see's that you are serious about getting the news involved he will likely have a new perspective on the matter. Hopefully.

Like I said before, if you really want your money or your ipaq you should go to the store and when they tell you no again call the cops from there yourself, and also call your local news bureau and tell them to come on down for some action, or at least give them your story and the managers name.

Why do you guys keep saying that foolishness? Don't you realize that not everyone has or wants credit cards because some people find paying interest on something that you don't need to foolish. This has nothing to do with spending cash, it has to do with shopping at a crappy store. I pay cash all the time and have never been screwed. It's all about where you shop and what you do when you feel like you have been wronged. I pay cash for everything and unless i'm shopping on the net, I would rather keep it that way. I don't need more bills, and higher ones just for using the damn things.

I think they contacted niles police. should i still contact my skokie police?

edit: what is the "AG"?

Seriously, you should have never left like that. You were the managers beeeeyatch when you left. Think about it, you pay $300 for an ipaq and you get a bag of sand?? I would be so f**king pissed. And if after raising hell, if the manager still didn't do me right, I would have to tell my dad. My dad is an animal when he is mad, he is like king kong on fire. And after that, I would get a lawyer to put the manager out of a job and make sure he is blacklisted in your whole city. It would become my holy war to make him suffer and watch him squirm in pain. Money becomes no object, time becomes of no matter. He must become the object of your wrath and angre. And when the day comes upon facing him in a homeless shelter, you can offer your hand to him and utter these simple words: "Bring forth an ipaq to me, and I shall give you life again." Then you two can become best friends in the whole wide world.

Have you called Compaq yet? Maybe you should tell them and see if they can do anything (like send you a replacement).

Yes, contact the Niles police. If OD contacted them, you want to talk to the same department so they have your side of the story. Otherwise, they're telling the police that they don't know what happened, except that it looks like you may have tried to steal an IPAQ.

EDIT: Actually, call everyone you can think of, call often, and don't go away until you get the Ipaq you paid for or the cash you paid. Good luck.

well guess what. having a credit card would damn near save joony's ass right now. for the following reasons:

1. Merchandise Dispute
2. Merchandise Dispute
3. Merchandise Dispute

Among other things, you dont have to use a credit card for EVERYTHING. Cash is still good, dont get me wrong, but there are just some things i like about credit cards better on expensive purchases.

You can dispute the charge with the credit card company. They dont pay OD when that happens, so they'll try to resolve it ASAP.
I also happen to have Amex Product Protection. That means if I bought the ipaq, and lets say someone snatched my bag while i was walking out of the store, Amex would buy me another one. If the product was broken accidentally, they would do the same.

I also have RETURN PROTECTION. That policy MAKES a return happen no matter what. If OD does not want to take the bag of sand back, guess what. Amex will. They will pay out up to $1000, per year, in either restocking fees or for the product itself if the merchant chooses not to honor a return, no ifs and or buts. This also covers sadistic ALL SALES FINAL policies.

Either way, it dosent hurt to use a CC on a large purchase, as long as you have the $ to back it up. Nobody's forcing you to pay 22% interest a month, or a $75 annual fee. There are plenty of good CC's out there that can protect consumers from bad products and service.

i'll tell my father to dump is discover card for a amex blue. He dosen't like using his credit card for some reason...

Ok, i will be going back to OD to verify where they talked to the police, then i will go to that police.

Well, now that you have your box of sand back, bring it back to OD and talk to the manager, arrange a meeting time with HIM AND THE EMPLOYEE that helped you. Then threaten them and say "Look, if this problem does not get resolved this instant, I am going to pay a lab to get the contents of this box fingerprinted and sent to the authorities and will bring your management and staff to the attention of the media, the corporate office and the police. You either refund me, or give me an IPAQ. Or this situation will escalate into a serious problem and I will be damn sure you guys will lose your jobs."

You need to sound serious and firm. Bring along someone older that looks like a lawyer to say that for you. They will be sh$tting in their pants.

oh yeah, i called compaq and i was on hold for more then 15 minutes haven't been able to get a hold of anyone, i called at the store!

the manager said "this matter is aready being investigated" probably more like doing nothing.

Won't your father go there with you and speak up for you? It will look better if an older person goes in with you and backs you up. This is totally wrong, and should not be happening. You really need to get a local news station involved here immediately, because they will make OD quake in their boots by telling them they are going to air their dirty laundry. You are not taking enough steps. You need to do everything in your power to get your money back, no matter what you need to do, including but not limited to going to the news, the BBB and any other organisation you can think of. Good Luck

It doesn't matter where he frickin' reported it! You file a report seperately. You are no longer working WITH O.D., you are working AGAINST O.D. Don't wait for the manager, he isn't going to help you report him to the police.
