Also out of fear of having HIV she might and should be taking pills right now as a safety measure. This will help slow down the disease and this is common practice for health care workers just in case they came in contact with the disease.

Her biggest risk is hepatitis. It is VERY hard, if not near impossible to get HIV from ingesting the virus.

It is possible but rare to get HIV by kissing.

This is not the same as kissing.

This is why health care workers wear gloves when they touch people who are bleeding.

The human lip has many cuts and she came in direct contact with the blood.
 
I think she could potentially get more than $10k. There is a very real and potential chance of becoming ill with something or another due to the blood. As such getting tested, as she is doing, is definitely a must. It would have been perfectly reasonable for McDonald's to pay for her medical bills, and they should have been more than happy to do that.

Since McDonald's essentially blew her off and more importantly has a history of ignoring health issues regarding their customers (e.g. the coffee incident), I very well see her being awarded punitive damages in excess of that $10k.

It appears that the lady was reasonable and did what she should have done, but McDonald's basically ignored her. That is unacceptable behavior on the part of the corporation.

Have you (or anyone else) thought that perhaps maybe it was truly an accident? Fast food moves at a very quick pace, it's possible that the employee got cut without realizing it (happens to me working on computer cases all the time). It may not have been intentional. And...how much blood was it? Just a little smear? Do we really know all the facts here??

Again, contraction of HIV by ingestion is so rare, it's just silly to administer prophylactic drugs that have hard core side effects. In fact, I bet you'd be hard pressed to find ANY cases of infection through ingestion of the virus.

Well yeah but so many people are like "OH GIVE HER $5 MILLION!!" That's ridiculous. Sure there is fault but if truly an accident it's not like there was any malicious intent with the employee doing it on purpose. The point is we just don't know everything, so people coming on here and saying that this should happen or that should happen is very premature and useless.

That is absurd. Sure it's gross, but until there is proof that she contracted some sort of illness or disease from it - she deserves only medical bills and perhaps the modest $10,000 settlement. She doesn't deserve millions of dollars for this.

I agree, I think McDonalds needs to be made an example of in this case. Blowing off something like this requires a healthy verdict. I would say something north of 100K not so much for her suffering but to teach McDonalds a lesson.

She only wanted her medical bills paid for at first, but the showed her they didn't care. So now she has to sue them. They should pay punative damages so this isn't done again. 1 Million seems fair to me.

I work in a laboratory and at times I deal with biological substances (i.e. blood) and if I was to ingest it you always, always, always, always, assume the worse.
