I've seen a couple of those movies or scenes from them and they are definitely over the top but all of the people were 18+ and consenting. I don't think there was anything illegal and this is pretty sad. Give me a minute so I can find a way to blame this on Bush. :)

I think the one of the issues is that the girls weren't completely aware of what they were getting themselves into. I've read that the girls in the videos cry while this is going on because he's going so rough with them. But I haven't seen any of the videos, so I don't know firsthand.

I guess the people who've subscribed to his website didn't find it disgusting at all.

So the FBI signed up to his website and had some dvds delivered to Tampa and from there they were able to invoke Tampa's "community standards" and bring Little to trial for 20 counts of obscenity; he was convicted on 10 of the counts.

A female judge and the jury (7w, 5m) seeing 8 1/2 hours of the videos sure didn't help his cause.

I was totally against this ruling, especially since they moved the case to Tampa, which has strict anti-obscenity laws after losing in CA. But then I read this essay on the type of things you find in his movies from someone who's been on the sets (NSFW):

Indeed. I wasn't aware consenting porn with 2 - 18+ adults was illegal. I have seen a clip or two before and while they were not my cup of tea, I didn't see anything that would be considered breaking the law.

Hopefully this will get overturned on appeal. The SC usually rules for the 1st amendment protections, even the conservative ones. Disgust is not enough to justify a jail sentence.

What's problematic is that in the internet age, anyone anywhere can access a site, so to apply a local obscenity charge to an internationally available website can have a chilling effect on speech.

That the actors were paid?
That the act itself is too disgusting to qualify as free speech?
That actions are not speech and so not protected?

This is ridiculous. I always thought Max Hardcore was a disgusting pig, but even I don't think he should go to jail for obscenity. My biggest concern with him has always been that he seems to abuse the girls who work for him past what would be considered "acting" for the scene he's filming. And because he degrades them so much and has built an entire studio on filming these kinds of humiliating acts, they wouldn't be able to successfully charge him with anything (not to mention most of the girls probably don't have the cash to hire a lawyer anyway).

If anything, the guy should be investigated for assault, battery, threats, etc. Stuff like that (IMO, all porn directors that regularly use this stuff need to be looked at a little closer than normal). But not obscenity. I don't think obscenity should exist - it's an affront to free speech. And a ruling like this would simply open the door.

and its public. its not hard for a prospective max hardcore hire to view his previous videos. this prosecution is full of it. its just legislating taste and thats bad in a country that is supposed to have free speech. the only speech that needs protection is the unpopular kind after all.
