I would not say the the OP was too close. I drove in NYC for over 20 years and know the crappy roads they had / still have. I lost 2 tires on the FDR underpass northbound near 96th street. Something on the road, sliced them both down. Never did see it and I was not the only car that had hit it that night. You can try and make the city pay, but it is a long shot at best. You are looking at about $1500 or so in repairs, counting 2 tires, 2 rims, possibly damage to brakes, hopefully just a front end alignment or at worst, replacing bent parts (like tie rods) ... and that is presuming no body work damage.
