Why wouldn't this be dealt with during a divorce settlement?

Read this on CNN today. This guy's got big brass ones. He had the balls (or the male stupidity, most likely) to do what we've all dreamed of doing. Though he didn't do it right b/c he doesn't have enough money to disappear.

I don't recall the story saying anything about kids (IIRC), so it's not like he ran out on kids (bad!). He got rid of the nagging wife with the fake eye contacts.

Of course, he screwed himself. If he's in the US, or ever sets foot in the US again, he'll be arrested for not answering the arrest warrant that I'm sure his wife's divorce attorney will get placed against him.

So, he was one of 16 people that won $17M? After taxes what did he get? $500K, maybe? That's six months of hookers and blow down in Mexico...or if he returned to India (I'm assuming that's where he's from) that's a lot of Rupees for...whatever they do for fun there.

AFA we know, as of right now, none. But here's what will happen.

1. Wife files for divorce citing blahblahblah and she's wants his money
2. Judge signs warrant for him to appear in court
3. He won't show, and is therefore automatically held in contempt of court and a warrant issued for his arrest
4. He's fucked.

I feel bad for her, I'm really surprised that her case was dismissed because the clip shows her in court with a female judge who I think would be more likely to side with her. Oh, and if keeping her lifestyle is so tough, why the hell doesn't she get a job and sell the house? Seems to me like she's sitting around on her ass waiting for a couple of bucks which are probably long gone and she'll never see now. Her "husband" probably went to Vegas and Mexico and spent all of it...when he turns up he'll probably be thrown in jail and I don't see how she can recover anything from him while he's in jail.

Talk about a dick move. If the guy wanted to run off with his winnings, fine, but at least leave his wife a little money so she can stay afloat for a while after he leaves.

Failure to Appear is an automatic bench warrant.

I dont think failure to appear in civil court is illegal. It simply means the person suing you automatically wins a default judgement. In fact the other side usually HOPES you dont appear, so they can put liens on your property to collect on a judgement.

The video indicates that he has been avoiding being served, does anybody know if you are responsible for failure to appear if you're never officially served? I'm guessing that as long as this guy isn't ever actually served notice to show up in court this woman is out of luck.

Doesn't he have to be served first? How can he fail to appear if he was never served, thus doesn't know he even has to appear? I think they said the sheriff tried to serve him for the divorce but couldn't locate him. Not sure where her divorce could go from there. I think she can get a divorce based on abandonment, but not sure she'd be awarded any of his money since his daughter collected the winnings anyway.
