It will be interesting to see how this plays out. I have heard LEO's state that once the assailants have been fought off and have left the building, the 'right' to use leathal force is no longer there. The rationale being, that they are leaving, let them go and file a report so the Law can pursue them. If you, a normal citizen pursue them and then kill them, you may be judged to have crossed the line. They ran, you stay in your house and be safe. You were no longer looking to be safe, you were looking to settle a score.

yea that's the rationale at least... it's retarded. you have no way of knowing whether they are running away or just going back out to call in more buddies or what. you should be able to do whatever the hell you want with people who try to harm you.

No. The run away to get reinforcements argument will get you nowhere. You really should lock everything down, summon LE, and arm yourself heavily until LE shows up and shows you some badges. A real creative criminal would have a surplus police crown vic, and a surplus light bar strapped to the roof (Total: $1000) to fool you into dropping your guard.

Investigators are trying to determine whether he inflicted the injuries while defending himself inside the apartment, or hunted down the burglars after they had fled.

I hope they give him a medal. When I first read that he got arrested, I said "hmph, must be either California or NYC...only there do innocent people who defend themselves get arrested!" If this happened in TX, they'd have thrown him a parade...then made fun of him b/c he's a hairdresser. :D

I dont know. In the UK that'd be a tricky one - would it be excessive force or not?

I guess you are thinking of the Tony Martin case. A farmer who had been burgled repeatedly got paranoid about it happening again. One night he woke up to barking, and found that two burglars were trying to make a getaway from his house, but had been caught by his rottweilers. He came downstairs with his shotgun and shot at them, killing one of them with a shotgun blast to the back.

The reason Martin was convicted was because he was not defending himself, but his property. The 16 year old he killed was trying to get away, and begging for his life and his mother, and Mr Martin shot him in the back. If the two robbers had threatened him, or carried a gun themselves, then I think he would have been cleared.

He is NOT a hair dresser!! The hair dresser shared the same office with him. He is an accupunturist and Kung-fu maister (ie: Kiss of the Dragon :D)

afraid not... last year someone in texas got life for killing a robber in his home... excessive force....
i personally think its a load of crap... they let themselves in however they want... u let them out however you want...
