I have also seen reports that retention upgraded phones and kept customers unlimited data. There have been multiple ways to take phone subsidy without giving up unlimited.

Not sure why it would be forbidden? It's not like you are getting free cellular service because you ordered a phone on the internet and because it doesn't activate until it's turned on. I've even told the Verizon reps and they mentioned that was a pretty smart thing to do because even they don't want to give up unlimited data.
