You're right 960 is a non issue; and a crap card at its price.....
Issue is 970 - Nvidia lied about the specs - doesn't matter *whoops its a mistake* or more likely - being an ISO 9000 cert corp.......they flat out lied; to bump their specs to match their competitors.....*hate to tell you this corps do this all the time to pocket the money; then deal with the fall out after which will cost them less than selling less and telling the truth*
My honest feeling is Nvidia didn't think people could catch on this quickly - right now they are screwed by consumers laws with false advertisement; and sellling item at wrong specs.
There is no ifs ands or buts how they will loose this case; its just how much they will settle for. They won't admit they did anything wrong again; just like bumpgate....yet people want to say this isn't a big deal or effecting people.
Tell that to people with SLI that it is effecting; or single 970s it is effecting. I know over here OCUK is taking all 970s back; hell they've said they are looking into taking 970s from other shops if other shops refuse to follow consumers laws here in the UK.
Class action suits are to deter bad behavior by corporations, not reward the injured consumers.
None of that mattered, the card performed exactly like it was suppose to. They won't loose the case, because it will be thrown out before it starts. It still blows my mind that people don't actually understand what false advertising is, yet they continue to throw it around on the internet without even researching it. If you want to know how terrible of a case using false advertising is look no further than the millions of cases stupid people try to sue for and lost. Because they thought false advertising actually means what it says. False advertising has nothing to do with the 970 card.
American`s is the reason why we have 10 pages of useless information to read before getting to install a software or start using a product. Because the manufacture need to cover all bases of stupidness to remove the threat of getting sued by a selfish american.

The site got one thing right, reduced ROPs and L2 cache from the original specs.
But they are not going to get anywhere with the "faster 3.5GB portion and much slower 0.5GB VRAM".
Because if they can do a 2+2 they understand that the only reason why the 0.5GB portion is slower is because it connected through a 32bit controller. The GPU can still access both 3.5GB and the 0.5GB at the same time, hence you get the same bandwidth as promised
