NBA spokesman Mike Bass released a statement Sunday night in response to Shelly Sterling's comments.

"Under the NBA constitution, if a controlling owner's interest is terminated by a three-quarter vote, all other team owners' interests are automatically terminated as well," Bass said. "It doesn't matter whether the owners are related as is the case here. These are the rules to which all NBA owners agreed to as a condition of owning their team."

In turn, Shelly Sterling's attorney fired back with a statement of his own.

"We do not agree with the league's self-serving interpretation of its constitution, its application to Shelly Sterling or its validity under these unique circumstances," attorney Pierce O'Donnell said. "We live in a nation of laws. California law and the United States Constitution trump any such interpretation."

hmm i don't see that holding up. What if there was a 3rd owner who has nothing to do with this. His ownership is terminated as well? i don't see that surviving a lawsuit.

IF his wife owns her own part of the team this is really going to be interesting.

terminated in the sense that a non-controlling minority partner never signed any NBA contracts and doesn't have any legal standing to be a franchisee. Such a person is just an investor in the team, and would receive his share of the investment from any sale.

Technically the team is owned by a family trust, so neither DTS or his estranged wife has direct ownership. Knowing how litigious he is, everybody knew going in this would get messy and take some time to resolve. That's assuming that 22 other owners vote to boot out Sterling, and I think that vote would be highly contingent on whether or not the votes are secret. I think the owners' votes won't be made public, so I could imagine some of them balking at Adam Silver's "maximum" penalty.

Not just them balking at the punishment, but it would be in their best interest to set a precedent not to simply boot owners for unpopular opinions. The NBA has been known to be pretty homophobic and how long until a player accuses a team of firing him or not signing him because he was gay. Does that owner also get the boot? How about if an owner fires a well beloved coach or does something outrageous (trades a high profile player or cuts him or something) that is extremely unpopular? Are they also subject to getting booted?

Sterling I dont agree with, but the pillow talk conversation was not racist. She is actually a racist.

Like I have said already, if she was posting up picks at HIS games with Icy Hot Stuntaz, he'd have a problem.

Mr. Sterling can't find a single ambulance chaser who wants a piece of a billion dollar pie? Especially since the NBA will have an extremely weak case in any court proceedings as it pertains to property law. Yeah the NBA constitution exists in a vacuum or bubble. I guess this is what passes as fact when political correctness proceeds logic.

Perhaps Magic Johnson and friends should have went with the pedophile angle instead. Does Donald Sterling own a computer??? lol?

I've never seen the contract between the NBA and a franchise. Can you link it to me?

I can't imagine the owners investing so much money into a lopsided agreement. I would think as games are the moneymakers that the scheduling of games would be one of the most important clauses in the agreement.

Just because - in trying to make himself a name - newly appointed commissioner Adam Silver has an itchy trigger finger, doesn't make his position legally valid.

Have you read parts of the NBA constitution pertaining to Mr. Sterling's *alleged* racism? I have. They have no legal right to take away his team, only levy a fine of upwards of 2M.

I know that Mary Hart has extremely sexy legs, but please stop getting your news from Entertainment Tonight. TIA
