I've never seen the contract between the NBA and a franchise. Can you link it to me?

I can't imagine the owners investing so much money into a lopsided agreement. I would think as games are the moneymakers that the scheduling of games would be one of the most important clauses in the agreement.

An nba team is a guaranteed profitable investment and is just about the best status symbol (well, behind an NFL or Premier league team) in the world. Of course they would be ok with a lopsided contract.

Also, this piece of shit's racism killed a nice old lady: http://www.thedailybeast.com/articles/2014/05/14/killed-by-donald-sterling-s-racism.html

“Is she one of those black people that stink?” Sterling is quoted as asking. “Just evict the bitch.”

Kandynce had kept paying the rent despite the apartment being flooded with ankle-deep water and lacking a working toilet, shower, or stove.

“Kandynce Jones was under threat of eviction by [Sterling] even though she had never missed a rent payment,” court papers say.

And yet, all you assholes are whiteknighting for a fucking monster. Oh, how lovely it is to live in a post racial society

Fuck it - I'll take the case. Billionaire client against multi-billion dollar entity - case could drag on for years. $$$$$$$$$$$$$$$$$$$$$$$

Donald - I'm here for you.

With an empha$i$ on years. You don't need to be a genius to see it. I believe the NBA will try to slowly bury this story and Sterling will retain ownership.

And how do they guarantee that profitable investment if they're not obligated to schedule games hmmm?

No one is white knighting for Sterling. Stop being a tool.

Most owners aren't stupid enough to be caught on tape saying horrendously racist shit. This guy has years of racism allegations stacked against him and he was never in danger of losing his team. It took him getting caught to get this to happen. The 29 other owners aren't that dumb.

Oh, and Sterling is going to make hundreds of millions of dollars off of the clippers sale, so it was an excellent investment for him, even though he's being forced to sell early.

And this thread is full of people straight up white knighting him.

Case in point:
QUOTE=bradley;36358347]Just because - in trying to make himself a name - newly appointed commissioner Adam Silver has an itchy trigger finger, doesn't make his position legally valid.

Have you read parts of the NBA constitution pertaining to Mr. Sterling's *alleged* racism? I have. They have no legal right to take away his team, only levy a fine of upwards of 2M.

I know that Mary Hart has extremely sexy legs, but please stop getting your news from Entertainment Tonight. TIA

So many racists in this thread.

I go back to my original point. How do you know the NBA has the authority to not schedule games for LAC?

TIL that wanting someone to have the benefit of due process makes you a racist. Yay proggies!

Sorry for having a *preference* for due process the rule of law for everyone over your rhetoric, rash judgement and mob rule for a few. However please enjoy your sanctimony. I can only imagine what's behind this particular keyboard.... probably a hot mess. :)

You're the one claiming that something is in the contract. Go dig it up.

These sports leagues are cartels with many, many rules that allow them to prevent people from buying, force people to sell, and otherwise regulate how they manage their team. You have to be a straight up idiot to believe that they don't have language that allows them to force a transparently, demonstrably racist piece of shit to sell his franchise (and reap hundreds of millions of dollars in profit).

Buying a pro sports team is privilege and there are FAR FAR FAR more rich people with a desire to buy a team than teams to buy. That gives the sports leagues ALL OF THE LEVERAGE.

Negative. You are the one claiming the NBA has blanket authority to not schedule games for a member team in good standing. Prove it.

There's only one idiot in this discussion and it would be the one without a clue as to legal contracts work.

Uh... you don't need due process of the law to know someone is a racist. Sorry, the only way to see this guy as anything other than a fucking racist, is to be racist.

Yes, because the NBA's lawyers don't are "without a clue as to legal contracts work."

You are an idiot.

Can you translate this into English for me?

You sound as if the NBA would be the only one in the transaction with legal representation.

So much butthurt for the modern progressives over the last 5 years.

You guys have lost literally every battle... Gun control is gone, zimmerman is free, it's been decided in a courtroom you can defend yourself against a felon thug crew who points anything at you (just can't shoot as they drive away), and now sterling has made this entire thing a non-issue.

I love how you all ignore the jacksons, the sharptons, any racist player if their skin color is burnt umber or darker. But if they're a medium ivory? Burn those motherf'ers.

I mean seriously, it has got to suck to be a modern progressive in this day and age. Your golden times were 1995-2000 or so. Get with the times! Nobody cares about color, no one wants gun control, just find another pedestal to stand on.

Maybe it's just because I'm a lawyer (once again Donald... send me your $$$$), but I do find this fascinating from a legal perspective. I have no clue what the NBA constitution says or any operating agreements between it and the Clippers, but even assuming that it clearly states the NBA can force the sale, banish Sterling, etc., I think it raises some very serious legal issues that would be interesting to see play out in court.

There are Constitutional (US - not NBA) issues regarding deprivation of property as well as antitrust issues regarding that type of exercise of power by the NBA.

Assuming this goes nuclear, I have no doubt that the NBA will have excellent lawyers advancing its position and Sterling will have equally capable lawyers advancing his. It is the type of case that could certainly make its way to the Supreme Court.

You don't think Silver consulted the NBA's legal team before pulling the trigger? Are you really this fucking stupid?

Again, pro sports teams are a luxury investment where there is a very limited supply. There are far more billionaires than top tier pro sports teams. Add to this the fact that the teams ALWAYS appreciate in value, and you get a situation where the league has ALL of the power. When one side has all the leverage, you get lopsided contracts. That's simple business.

Do you honestly believe that the NBA, MLB, and NFL fail to put language in their contracts that allow for these types situations?

Two separate issues:

1) I do believe there is language to terminate ownership. I'm not convinced it's legally enforceable especially in California (assuming that is the venue, which would be determined by the franchise agreement you can't produce)

2) I do not believe the franchise agreement gives the NBA power to schedule anything but an equal and equitable number of games among the member teams. Letting the NBA have complete schedule control with no rules would be insanity on the part of the owners.

Out of curiosity, what was the largest legal contract you ever entered into? $30k? $60k?

The best contract lawyer I know has never entered into one. So why even bring this up? If only to show you have absolutely no idea what you're talking about.

What does this mean, 'butthurt'? Is that anyone who disagrees with the right wing?

I think this is going to hit the courts and in a few years (don't see this happening fast! not with him fighting it) and be quietly dropped.

As for the NBA not scheduling them any games? not going to happen.
