His wife would absolutely do crazy shit like this.

Agreed.

Thing is getting away with it for a few weeks might work but in todays world unless he literally stays hidden in an underground bunker he will get caught in fairly short-order.

Between this...
Clarence Thomas was the lone dissent in the Supreme Court's January order rejecting Donald Trump's bid to withhold documents from the January 6 panel (msn.com)

and the collusion with his wife and Congress I'm this close to wishing someone dies in office before 2023. Can you think of a better reason?

Let's not mince words. Clarence Thomas, his wife, Trump, Cruz, Graham - and so many more are just garbage humans. The world would be better off without them for sure.

Can you imagine the Republican Rage if this was a D appointed Judge and a wife who was running around in 2016 trying to get Hillary installed as President?
Democrats need to stop being slackers and copy what Republicans do.

From what I've heard SCOTUS doesn't even have to explain. That branch of government needs a complete overhaul.

Thomas voted NO on a case where almost every legal scholar said was a no brainer and his wife was trying to stop the transition of power.

Can Thomas be impeached and removed for that vote? What does it take? Smells of corruption

Can he be impeached for it? Yes
Should he be impeached for it? Fuck yes
Will he be impeached for it? No, because we're broken

At this point, I'm just hoping for widespread karma. Otherwise, buying early on Brawndo stock.

$20 says he has COVID or died of COVID and they are hiding it for as long as they can.

Next time he appears on the bench, need to check to see if he's moving. They might try and string it out till after the next election.

So if he actually dies but they simply decide not to tell anybody for several years until there is an R president again do we consider that legit?

Doesn't seem so to me...

I'm convinced they would hide his death until GOP took over the Senate or White House.

Problem is not sure we have any laws to cover it. The major flaw in our system is it requires some level of trust and acting in good faith. Republicans do neither

Just getting snagged doing it would be a big problem at least ethically if not legally .... not that that matters much to most Republicans.

I highly doubt they could get away with the ruse for too long though.

I found something interesting. It bolsters my theory even if he died they would keep him either hidden or on life support until the GOP could replace him.
Originally Answered: what happens if a supreme court justice is not dead, but cannot perform their duties?
We know what happens because it happened to Justice William O. Douglas. He had a stroke in 1974 at the age of 76. He refused to retire despite a resulting disability. Seven of the other justices voted to defer to the next term any decision in which his vote would make the difference. He didn’t retire for almost a year despite urging from other justices. After retirement he tried to serve in a senior judicial status, but the other justices refused to cooperate. His long and distinguished career was partially marred by his hanging on when he could no longer function effectively. Yet there was nothing the President, Congress, or other justices could do to force him to retire.
If we ever reformed the Supreme Court by constitutional amendment it would be a good thing to add some provision for dealing with this kind of situation. What that provision should be is up for debate.
