as stated before.

just go in and plead guilty and ask for court supervision. that will keep the points off your record but you will still have to pay the fine.

Challenge Power.
Ok, here is what happend. There is an entrance to Pathmark, I went through it, then there is an exit that is past the light. I went through it, stopping at the stop sign. Thats it!
I told the cop another story when he asked me why I did that, so if he's there and i change the story I'm screwed.
Honestly, I don't see why its against the law; it doesn't put anyone in harms way and there was no sign in the lot that said 'NO THRU TRAFFIC'... but whatever, as long as there are no points for this violation I'm satisfied... I hope there isn't.

I would just be honest and tell the judge you didn't know it was illegal. I'm not sure if that'll get you anywhere but I'd certainly try it.

I concur. I have never heard of this being against the law. I mean, what?

If you're following all the other traffic regulations, I'm pretty sure you can drive wherever you please.

I bet it's state to state as far as this one goes.

lol notfred. I've noticed a trend as well. It seems like every traffic violation thread here was created by someone from NJ.

People In NJ are always in a rush to go nowhere. Every damn day I drive in NJ is like avoiding one big freaken accident.

What was it that you drove though? Parking lot?

If it was a strip mall parking lot you could say you mis took it for the wrong strip mall or wrong store. You will be able to talk to the prosecutor privately when you go to court if you chouse to.

It is your legal right to fight it, grant it would be the "right" thing to do to just to be honest joe and pay for the fine. That's just your decision. I wouldn't mind paying the fine, but If it includes a point on my license then I would definitely would want to fight it or at least just pay the fine and have the prosecutor knock off the points. Insurance is hard enough in this state.

Viper, I see you post in all these ticket threads, and always you don't know what is legal/illegal. I sure hope you don't drive my way. Just kidding. My mom got a ticket for doing that just before I got my driver's license. Thus I've never done that. You are right though, most cops won't enforce it - they have bigger problems to tackle. I think your advice may work, but likely if the cop shows up to court, you are screwed, mADMaLuDaWg.

Actually you'd be in much more danger of me flat out running you over, I can't see worth sh!t.

:p

Seriously though, if you can find me the Oregon statute that addresses that I'd be much obliged. I do 99.99% of my driving in Oregon, & honestly have no clue whether it's legal or not. I don't do it, but I couldn't tell you for sure if there were any laws addressing it. Note that Eli (above me) does not know as well, he is also from OR.

If it's illegal it's certainly not enforced here.

As far as I know, it is the store's right to stop trespassing on their property. Thus if the store decides that it has a problem with drivers using their property as a bypass, then the store will complain and get a cop to ticket people for a while. While some states may have specific driving laws against this, ALL states have no trespassing laws. So in Oregon if the store wants to prosecute you for trespassing, they'd win.

Edit: I cannot spell trespassing.

Any police officers or court judges on this board have any idea on whether the violation includes points?

Get caught doing that around here and its a reckless driving ticket.

4 point ticket (10 to lose your license) and a hefty fine.

Oh good Lord, do you really think any store is going to have someone outside flagging people down for trespassing? Sounds like a great way to waste money & alienate potential customers.

Am I also trespassing if I meet someone in the parking lot of a store with no intent of going inside?

You are really stretching on this one.

The ONLY thing that matters is whether or not a given state has a statute forbidding it.

I don't know what you originally told to the cop... but a story such as "I thought I needed it, but as soon as I got into the lot, I remembered I don't need it anymore, so I just exit the lot without any illegal driving..." would have saved your ass... the cop sounds like an ass...

dullard: do you think that's a smart practice? I don't think any store will do such a thing. Or else they will lose customers, a lot of them.

What is the charge on the ticket? Should include a number. If it's a "moving violation" then it counts to 2 points on your license.

2 pointa is not big deal to someone older then 25. But two points for someone younger than 25 makes your insurance rate increase a good 15-20% for 3 years.

I was gonna say "Remind me to bomb (insert your town here)" ... but I think that might be crossing the line.

There is no charge on the summons form. Its not listed and the cop put it under "Other Traffic/Parking violations"

Probably going to be very minor then. Find your state's statutes & look for it (though it's likely going to be hard to find).

Whats court supervision?

you plead guilty pay the fine/ticket and for a year IF you dint get another ticket in the year then the original does NOT go on your record. but if you get one then both go on.

i have been on court supervision a few times. saved me from having multiple speeding tickets! heh.

Oddly enough we were bombed (Oklahoma City) a few years back, but I think it had little to do with the traffic courst system. :p

That's illegal? I do this once in a while. What if I need to make a right turn, and there are cars waiting to go straight in the same lane stuck at a red traffic light. I'll sometimes make a right turn earlier, at a gas station or whatever is at the corner and exit from there. Will I get a ticket for that?
