Just got rear-ended.

Was coming home from downtown and some drunk dude slammed into the back of my car. What's amazing is, there is no visible damage to my car but his truck's bumper got completely screwed up. All the same I got his DL#/ insurance info and I'm going to take it to the dealer to see if there's any damage and get an estimate if any. But the earliest I can do this is Monday - anyone have any suggestions on what if anything I can do in the meantime? Should I file a claim with his insurance even though I don't know the extent of the damage yet? What info should I have when I do? Never been in an accident before, any suggestions are welcome!

phew, at first i was like, holy sh!t dude that car is brand new!

do you have gap insurance?

you can file a report with the police tommorow. go to the local station where the accident occured. file the report, report it to insurance, then get it checked out monday.

Gap insurance? I have Allstate comprehensive and collision - not sure what gap insurance is.

Just call up your insurance and let them deal with his insurance

If I do this though, won't my premium go up, even though its not my fault? Can I just call his insurance and get what I need from them?

gap insurance covers the gap between what the car is worth and how much you owe on it. of course i don't know if you owe anything on it or if you're upside down if you do or what.

Don't think I got that...should I even bother bringing this up to my insurance company?

He was drunk and you just let him go off?

He readily volunteered all his info (and it checked out) and he was pretty cool about it. There probably wasn't anybody on the road that's driving around downtown Austin at 3 am that hasn't had a few drinks. I'll get what I need from him but I didn't see any need to crucify him over it by getting the cops involved.

Um, are you joking? Most insurance companies don't deal with individuals - they deal with other insurance companies. What in the hell makes you think his insurance company will bypass yours and deal with you directly? Not to mention he was drunk - why the hell did you not call the cops?

not to mention all the cops are tied up on 6th because of the paranoia from mardi gras 2 years ago.

upside down is the term for when the insurance company would pay out, in the event of the car being totaled, less than is owed on the car. the difference is the gap. so gap insurance would be to cover that. its not very expensive, and if you haven't heard of it then you're probably not upside down, because the dealer would try to sell you gap insurance if they thought you were. heck, they'll try to sell it to you if you're not.

Easy there killer. Like I said, I've never been through this before. I figure if I can get by this without involving insurance and getting a premium hike, that would be the best way out, but if I have to get my insurance involved so be it.
