The threatening others is where it crossed the line for a lot of people imho.

And those same people will just classify it with 4 words without even any second thought: FAFO.
One could just as easily say the person responsible for the death is now in the "find out" phase.

Everything that followed.

I just can't see a way where Penny is guilty of murder in this.

No not everything. His actions didn’t warrant death. A man took the law into his own hands, and when warned by fellow passengers to release the person he was choking, this man did not do that but continued to choke him even after any threat was already neutralized …and thus is culpable in the victims death. Victim blaming is not a good look.

There's tons of people that're weird in public.

You might have seen the performances in the subway with boom boxes or playing instruments or singing or doing gymnastics for tips.. or just plain pan handling.. but none of those people were ever threatening others. Neely clearly was and that's not even disputed.

How specifically was he "threatening" people? Was he waving a weapon? Did he raise a hand acting like he was going to hit them? Did he say scary words without any obvious way to act on them?

IMHO Daniel Penny should never have been charged with anything and hopefully the jury will not find him guilty of the remaining charge.

It's a shame the jury had a few sociopaths that could not convict on the manslaughter charges

I don't think it was murder! (what was the motive for murder??)

Hell it wasn't even TOPO.

They tried to hold him down till the cops got there. The guy was high on drugs which likely contributed to his own demise by injuring his organs.
You don’t get to kill someone for being annoying. My earlier example if in a public pool there is an ass grabber you don’t get to hold his head underwater for 10 min to get him to stop

Sounds like at least manslaughter

Probably not great that you can basically just outright murder a mentally ill homeless person in NYC and expect no consequences.

That people hate disorder more than the value actual lives is however consistent.
NY is just expanding on the number of ways to kill people and just get away with an "oopsies".

The manslaughter charge that was dismissed because jury was hung. Will prosecution retrial the case?

I believe that charge was dismissed. Jury could only consider negligent homicide after the higher charge was resolved in some fashion.

If the victim is deemed to have no value socially more or less yeah. Surprised Pikachu face on the C level execs though who suddenly realize this could apply to them also.

I was also thinking of vehicular homicide. Hit someone with a car and stay at the scenes, walk away scot-free.

Interesting how many people have their panties in a bunch about the killed UHC CEO when he is responsible for many deaths.

Jordan Neely killed no one. Clearly CEO lives are valued more.

I really doubt he gets guilty.. people in NYC are so pissed off at what's happening on subways and they will use Neely as a weapon to make a point.

He will get off completely free.

Called it!
